FROM THE BOND OF MATRIMONY
THIS CAUSE, which has been regularly docketed, matured and
set for hearing, came on this day to be heard upon the plaintiff’s
Bill of Complaint, upon waiver of service of process thereof upon
the defendant, said waiver having been filed with the Court; [ OR ,
upon proper and lawful service of process on the defendant of the
bill of complaint, upon the amended bill of complaint, upon the
answer to the amended bill of complaint having been filed by the
defendant,] and upon the depositions of witnesses on behalf of the
plaintiff, duly taken before a Notary Public, and filed herein,
[and upon motion of the plaintiff for entry of the final divorce
decree, after proper and lawful service on the defendant of the
notice of entry of final divorce decree, and was argued by
counsel].
UPON CONSIDERATION WHEREOF, the Court finds from the evidence,
independently of any admissions of the parties in the pleading or
otherwise, the following facts: that the parties are over the age
of eighteen; that they were lawfully married in CCC County,
Virginia, on DDD; that there were no children born of this marriage
or adopted, and that no children are presently expected; that the
plaintiff was domiciled in and was and had been an actual bona fide
resident of the Commonwealth of Virginia for more than six months
immediately preceding the commencement of this suit; that neither
party is an active member of the Armed Forces of the United States
of America; that plaintiff and defendant last cohabited as husband
and wife in the County of , Virginia; that the plaintiff is a
resident of the County of , Virginia, and the defendant is a
resident of County, Virginia; that the parties have lived
separate and apart , without any cohabitation and without
interruption for more than six months, to-wit: since DDD, 2002,
which has been fully proven by the evidence; that the parties have
entered into a Separation Agreement dated DDD2 and have thereby
distributed their property, both real and personal; and the
plaintiff is entitled to the relief prayed for.
IT APPEARING to the Court that the parties to this cause have
entered into a Property Settlement Agreement in accordance with the
Code of Virginia section 20-109 and that same is fair and
equitable, it is ADJUDGED, ORDERED and DECREED that said Agreement
and Stipulation hereby is ratified, affirmed, and incorporated, but
not merged, into and made a part of this Final Decree of Divorce
and the parties shall fully comply with the terms contained herein,
and it is further
ADJUDGED, ORDERED and DECREED that the plaintiff, xxx (Social
Security No. SSS - SS - SSSS) is now absolutely divorced from the
defendant, yyy (Social Security No. SSS-SS-SSSS), from the bond of
matrimony on the ground that the parties have lived separate and
apart without any cohabitation and without interruption for more
than six months, pursuant to section 20-91 of the Code of Virginia,
1950, as amended, and that the bond of matrimony created by the
marriage between these parties as of DDD is hereby dissolved.
And nothing further remaining to be done herein, it is
ORDERED that this cause is stricken from the docket and the papers
placed among the ended causes.
The Clerk shall send a certified copy of this Order to Attorney
