VOLUNTEER CAREGIVER AGREEMENT

This Volunteer Caregiver Agreement (the Agreement) is entered into by and between:

RECITALS

WHEREAS, the Organization provides community-based care services to persons in need of assistance with activities of daily living; and

WHEREAS, the Volunteer desires to provide caregiving services on a voluntary basis under the Organization's supervision and subject to the terms and conditions set forth in this Agreement; and

WHEREAS, the parties intend by this Agreement to memorialize the scope, duties, obligations, and legal responsibilities applicable to the Volunteer and the Organization.

SCOPE OF WORK

The Volunteer will perform caregiving and support tasks as directed by the Organization. Services may include direct personal care, companionship, light housekeeping, meal preparation, medication reminders, transportation to appointments, and documentation of observations. The Volunteer will perform only tasks for which the Volunteer has been trained and authorized.

PAYMENT AND REIMBURSEMENT

The Volunteer acknowledges that participation is voluntary. The Organization will not treat the Volunteer as an employee for wage, tax, or benefits purposes unless a separate written agreement states otherwise. The Organization may provide reimbursements for preapproved, documented out-of-pocket expenses incurred while performing authorized duties.

TERM AND TERMINATION

This Agreement commences on the Start Date and continues until the End Date or until terminated as provided below.

Either party may terminate this Agreement for any reason upon the delivery of written notice in accordance with the notice period above. The Organization may terminate immediately for cause, including but not limited to misconduct, breach of policy, gross negligence, or falsification of records.

CONFIDENTIALITY

The Volunteer acknowledges that in the course of providing services the Volunteer may obtain access to confidential or personally identifiable information concerning clients, their families, or the Organization. The Volunteer shall maintain the confidentiality of such information and shall not disclose, reproduce, or use confidential information except as required to perform authorized duties or as required by law.

Upon termination of this Agreement, the Volunteer shall return all materials, records, keys, and documents containing confidential information. Exceptions to this obligation exist only where disclosure is compelled by lawful process; in such event the Volunteer shall provide prompt notice to the Organization to the extent permitted by law.

TRAINING, BACKGROUND CHECKS AND HEALTH

The Volunteer agrees to complete required training and background checks as a condition to performing services. The Volunteer certifies that, to the best of the Volunteer’s knowledge, the Volunteer is physically and mentally able to perform the duties identified in this Agreement and will promptly disclose any change in health status that materially affects the Volunteer’s ability to provide safe care.

LIABILITY, INSURANCE AND INDEMNITY

The Organization maintains general liability coverage for its operations; however, the Volunteer is encouraged to maintain personal insurance as the Organization's coverage may not cover all volunteer activities. To the fullest extent permitted by applicable law, the Volunteer agrees to indemnify and hold harmless the Organization, its officers, employees and agents from any claims or liabilities arising from the Volunteer’s negligent acts or omissions while performing duties under this Agreement. This indemnity does not apply to claims arising from the Organization’s gross negligence or willful misconduct.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state of , without regard to principles of conflicts of law.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous negotiations, representations, and agreements, whether written or oral. Any modification of this Agreement must be in writing and signed by both parties.

MISCELLANEOUS

If any provision of this Agreement is held invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect. Headings used in this Agreement are for convenience only and shall not affect interpretation.
