What a Volunteer Fire Department Agreement Does

A Volunteer Fire Department Agreement is a written contract that defines the relationship between a volunteer fire department and an individual or supporting organization. It sets out duties, scope of services, membership or deployment terms, training and certification requirements, equipment and vehicle use rules, insurance and indemnity provisions, and the effective date and termination mechanics. The agreement documents expectations for emergency response, mutual aid, medical transport, and other operational support, and it can be tailored for municipal, county, or independent volunteer departments.

Why a Clear Agreement Matters

A written Volunteer Fire Department Agreement reduces operational ambiguity, clarifies liability and insurance, and records mutual obligations. Proper execution supports enforceability under the federal ESIGN Act (15 U.S.C. §7001) and state UETA laws, while aiding compliance with local procurement and risk-management requirements.

Why a Clear Agreement Matters

Who typically completes this agreement

The Volunteer Fire Department Agreement is used by municipal officials, fire chiefs, volunteer members, and partner agencies to document roles, expectations, and legal protections.

  • Municipal officials: City or county administrators and risk managers who approve interlocal or service contracts.
  • Fire leadership: Chiefs and captains who define operational duties, training, and equipment use.
  • Volunteer members: Recruits or active volunteers who sign to accept duties and acknowledge policies.

Parties should ensure authorized signatories and any required local approvals are identified before submission to avoid delays.

Typical signers and their responsibilities

Fire Chief

The fire chief signs to accept operational terms, confirm training and equipment standards, and bind the department to mutual aid and response obligations. The chief often coordinates insurance coverage and incident command responsibilities.

Municipal Administrator

A municipal or county official signs to commit public funding, approve indemnity and insurance clauses, and ensure the agreement aligns with procurement rules and local ordinances.
