What a Volunteering Agreement Covers

Volunteering Agreement is a written contract that sets expectations between a volunteer and an organization. It documents role description, time commitment, supervision, confidentiality, safety and insurance arrangements, background-check consent, and any equipment or reimbursement terms. When signed, it clarifies liability allocation and grounds for termination or removal. The agreement can be executed on paper or electronically; e-signatures are generally valid under U.S. law when the parties consent and records are retained. Use this template to standardize onboarding, reduce risk, and ensure consistent volunteer management across programs.

Why a Volunteering Agreement Matters

Provides clear roles, safety expectations, and legal protections for both volunteer and organization. A formal agreement reduces ambiguity, documents consent for background checks, and supports compliance with insurance and privacy obligations, improving program reliability and risk management.

Why a Volunteering Agreement Matters

Who Completes and Signs This Agreement

Volunteers, nonprofit staff, program managers, and supervising staff use the Volunteering Agreement to document duties, availability, and conduct expectations before service begins.

  • Volunteer: individual providing unpaid time who must accept duties, confidentiality, and safety rules.
  • Organization: nonprofit, school, government agency, or charity that outlines duties and liability terms.
  • Program manager or supervisor: oversees volunteer work, confirms requirements, and documents performance issues.

Legal counsel or HR may review agreements for liability, background-check language, and state-specific consent requirements.

Step-by-Step: Prepare and Execute the Agreement

Follow these sequential steps to complete, review, and execute a Volunteering Agreement accurately with clear roles and signatures.

  • 01
Prepare: Collect volunteer details and required supporting documents before drafting.
  • 02
Draft: Define duties, schedule, insurance, background-check consent, and termination terms.
  • 03
Review: Have program manager and legal counsel review for compliance and clarity.
  • 04
Sign: Obtain signatures and dates; record method of signature and retention plan.

Core Elements to Include in a Volunteering Agreement

A professional Volunteering Agreement combines scope, safety, legal protections, and operational details to manage expectations and reduce organizational risk across volunteer programs.

Parties

Identifies organization and volunteer, including legal entity name and volunteer's full legal name, and specifies whether the individual serves as volunteer, intern, or contractor to clarify legal classification.

Scope of Work

Defines duties, expected schedule, location, supervision, deliverables, special project milestones, and performance measures to avoid mission creep and set clear expectations.

Safety & Insurance

Specifies required safety training, personal protective equipment, and whether the organization provides liability insurance or requires volunteer coverage; clarifies who bears medical costs for incidents.

Confidentiality

Includes confidentiality obligations for sensitive information, data handling instructions, and record-retention or non-disclosure provisions; specify duration and permitted disclosures.

Background Checks

State whether background checks are required, the scope and consent process, and consequences of disqualifying findings; ensure compliance with state law and FCRA requirements and recordkeeping.

Termination

Outlines grounds for removal or resignation, notice requirements, post-termination obligations, and property return procedures including access revocation to limit ongoing liability and protect assets.

Essential Information to Collect

Volunteer Name: Full legal name as on ID
Contact Details: Phone, email, full mailing address
Emergency Contact: Name and phone number
Role & Schedule: Duties and expected hours
Background Consent: Signed consent for checks
Signature & Date: Signed name and execution date

Risks When the Agreement Is Incorrect or Incomplete

Liability Exposure: Potential claims for negligence
Invalid Release: Unenforceable waiver or release
Background Errors: Improper checks risk litigation
Minor Consent: Unauthorized minor participation issues
Privacy Violation: Improper handling of PHI
ESIGN Noncompliance: Missing consent or records

Common Preparation Mistakes to Avoid

  • Using vague language about duties or time commitments leads to misunderstandings and operational conflicts; use measurable expectations and clear supervision lines to avoid disputes.
  • Failing to obtain explicit background-check consent delays onboarding and may violate FCRA or state consumer-report laws; include clear consent and disclosure language.
  • Not documenting training, safety briefings, or equipment provided can raise liability issues after incidents; record completion dates and trainer names.
  • Applying a standard agreement without considering minors, international volunteers, or state-specific notarization and data privacy rules increases legal risk; tailor per jurisdiction.
