Fill and Sign the Waiver and Release with Regard to Installation of Indoor and Ourdoor Christmas Decorations Form

Waiver and Release with regard to the Installation of Indoor and Outdoor Christmas Decorations Agreement made on the       day of       , 20       , between       , of       , (street address, city, county, state, zip code) referred to herein as Homeowner, and Little Elves, Inc. , a corporation organized and existing under the laws of the state of       , with its principal office located at (name of state)       , referred to herein as Little Elves (street address, city, county, state, zip code) . Whereas, Little Elves is in the business of the installation of temporary indoor and outdoor Christmas lights and decorations, and related services, working mostly on residential homes and some commercial properties; and Whereas, Little Elves installs lights before Christmas and then comes back after January 1 to take them down; and Whereas, part of the consideration for these services is the execution of this Waiver; Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Homeowner hereby releases, assumes the risk of, and waives all liability caused by, and claims, demands, actions, and causes of actions whatsoever for personal or property damage in carrying out the services performed By Little Elves described above. 2. This Release, Waiver, and Assumption of Risk not only includes Little Elves, but also its agents, employees, volunteers, representatives, officers, and directors, all of which are hereby referred to as the Releasees, and covers injuries or damages caused by, arising out of, or relating to the services described above whether caused by, arising out of, or relating to negligence of Releasees or otherwise. 3. Homeowner further agree to indemnify, save and hold Releasees harmless from any loss, liability, attorneys’ fees, damage, and/or costs that Homeowner may incur arising out of or related to the services described above, whether caused by the negligence of the Releasees or otherwise.
