What a Water Use Agreement Is and Why It Matters

A Water Use Agreement is a formal written contract that allocates rights and responsibilities for the use of surface water or groundwater between property owners, utilities, agricultural users, or municipal entities. The agreement typically describes authorized volumes or rates, the permitted purpose (for example irrigation, domestic, or municipal supply), metering or measurement requirements, the term or duration, and any compensation or cost‑sharing arrangements. It may include conservation obligations, dispute resolution procedures, and requirements to comply with state water permits and reporting. Parties often record or file the agreement with local land records when required.

Why a Clear Water Use Agreement Reduces Risk

Water Use Agreements provide legal clarity about who may use water, under what conditions, and for how long, reducing disputes and facilitating permitting and financing. They help manage scarcity, document obligations for conservation and maintenance, and create enforceable terms under state water law.

Why a Clear Water Use Agreement Reduces Risk

Typical Parties and When They Participate

Common parties who prepare or sign Water Use Agreements include public agencies, private landowners, utilities, and agricultural operators.

  • Public water suppliers and municipalities managing municipal allocation, metering, and reporting obligations.
  • Ranchers, farmers, and irrigation districts documenting diversion points, quantities, and rotation schedules.
  • Private property owners negotiating groundwater or surface rights, transfers, or shared use agreements.

Specialized counsel, water resource managers, and recording offices are often involved to ensure legal sufficiency and proper filing.

Core Elements Every Professional Water Use Agreement Should Include

A professional Water Use Agreement clearly identifies parties, scope of use, measurement standards, duration, transfer rights, compensation, and compliance obligations to create enforceable, auditable water-use arrangements.

Parties

List full legal names, contact information, and authority to bind each entity. Specify capacity (owner, lessee, utility) and include organizational identifiers for companies or public bodies.

Water Rights

Describe legal basis for the right (appropriation permit, riparian entitlement, contractual lease), point of diversion, priority date, and any recorded liens, conditions, or permit numbers tied to the allocation.

Quantity & Metering

Specify authorized volumes or flow rates, measurement methods, meter types, calibration schedules, reporting intervals, and remedies for overuse or meter tampering, including notice and adjustment procedures.

Term & Transfer

State commencement and expiration dates, renewal options, assignment limitations, and procedures required for any transfer of rights, including notice, consent, recording requirements, and any fees or regulatory approvals.

Liability & Indemnity

Allocate risk by defining indemnities, insurance minimums, limitation of liability clauses, and responsibility for environmental compliance, contamination remediation, damages from unauthorized use, including caps and third-party claim handling.

Dispute Resolution

Identify governing law, venue, negotiation timelines, requirement for mediation or arbitration, and procedures for injunctive relief or emergency remedies to protect water access, including cost allocation and expert determination processes.

  • Neglecting to record agreements in county land records when required may leave subsequent purchasers unaware and harm priority rights.
  • Relying solely on handwritten initials or unsigned pages can make the agreement vulnerable to challenges or invalidation in court.

Permit Noncompliance: Fines, permit suspension
Overuse Liability: Restoration costs, reduced allocations
Recording Failures: Unenforceable against third parties
