What a Watercraft Sales Agreement Covers

A Watercraft Sales Agreement is a written contract that records the sale and transfer of a vessel between a seller and buyer. It identifies the parties, describes the vessel (including hull identification number or HIN), states the purchase price and payment terms, allocates risk and liability, discloses known defects, and sets out title transfer and registration responsibilities. This document can be used as a bill of sale and proof of ownership for state registration and financing purposes; it also documents any warranties, liens, or inspection results agreed between the parties.

Why a Clear Agreement Matters for Buyers and Sellers

A signed Watercraft Sales Agreement reduces disputes, clarifies who pays taxes and fees, documents title status, and preserves evidence of transfer. It protects both parties by setting expectations for delivery, registration, and any post-sale obligations under state law.

Why a Clear Agreement Matters for Buyers and Sellers

Who Typically Uses a Watercraft Sales Agreement

The agreement is used by private sellers, dealerships, brokers, lenders, and insurance professionals involved in vessel transactions.

  • Private sellers and buyers completing a one-off vessel sale, documenting price, condition, and title transfer obligations.
  • Marine dealerships and brokers who sell multiple vessels and need consistent terms, disclosures, and evidence for registration.
  • Lenders and lienholders that require clear title language and lien release procedures before funding or recording security interests.

Use a written agreement whenever ownership, money, registration, or lien issues exist to reduce post-sale disputes and to support legal or insurance claims.

Essential Sections to Include in the Agreement

A professional Watercraft Sales Agreement groups terms into clear sections so each party's rights and obligations are readily enforceable.
