WEDDING PHOTOGRAPHY CONTRACT

RECITALS

WHEREAS, Client desires to retain Photographer to provide wedding photography services in connection with Client's wedding event described herein; and

WHEREAS, Photographer represents that Photographer has the skill, experience, equipment, and personnel necessary to perform professional photography services for the wedding; and

WHEREAS, the parties wish to set forth their respective rights and obligations with respect to the provision and payment for such photography services.

NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows:

1. SERVICES

Photographer shall provide professional wedding photography services (the Services) on the wedding date and times set forth in Section 2. Services include photographic coverage, post-production editing, and delivery of the Deliverables specified below. Photographer shall provide services in a professional manner consistent with industry standards.

4. COMPENSATION AND PAYMENT

Client shall pay Photographer the total fee described below. A non-refundable deposit is required to reserve the wedding date. Remaining balance is due prior to or on the wedding date unless otherwise agreed in writing.

Late payments shall incur interest at a rate of per month on overdue amounts. Methods of payment accepted shall be as agreed between the parties.

5. CANCELLATION AND RESCHEDULING

If Client cancels this Agreement for any reason, the deposit shall be retained by Photographer as liquidated damages. If cancellation occurs less than sixty (60) days before the wedding date, Client remains responsible for the balance of the contract unless Photographer re-books the date for equivalent compensation. Requests to reschedule are subject to Photographer's availability; any additional fees or price adjustments for a new date are the responsibility of Client.

6. TRAVEL, MEALS AND REIMBURSEMENT

Client shall reimburse Photographer for reasonable travel expenses, hotel accommodations, parking, and meals when the event locations require travel beyond a 50-mile radius from Photographer's principal place of business. Travel and accommodation arrangements and estimated costs shall be agreed in writing in advance.

7. COPYRIGHT, LICENSE AND USAGE

Photographer retains all copyright and moral rights in the photographs, including raw images, negatives, and digital files. Photographer grants Client a non-exclusive, non-transferable license to reproduce and display the delivered images for personal use, private display, and non-commercial distribution to family and friends. Client shall not sell or license images for commercial use without Photographer's prior written consent and a negotiated license fee.

8. MODEL RELEASE

Client hereby irrevocably grants Photographer the right to use uploaded and delivered images for Photographer's promotional purposes, including but not limited to advertising, portfolio, website, social media, and print samples, unless Client checks the box below to withhold promotional use.

9. DELIVERY SCHEDULE

Photographer will deliver edited images within weeks following the wedding date, unless delayed by factors beyond Photographer's reasonable control. Digital delivery will be by electronic download or other agreed method. Any change in the deliverables or schedule shall be documented in writing and signed by both parties.

10. CLIENT RESPONSIBILITIES

Client agrees to provide Photographer with a detailed timeline and a list of requested formal portraits at least fourteen (14) days prior to the event. Client is solely responsible for securing venue permissions and for obtaining any required permits. Client shall ensure that Photographer has access to necessary power and a meal during coverage longer than four (4) hours.

11. LIMITATION OF LIABILITY AND INDEMNIFICATION

Photographer shall exercise reasonable professional care in performing services. In the unlikely event of Photographer's total failure to deliver images, Photographer's liability shall be limited to a refund of all payments received from Client. In no event shall Photographer be liable for consequential, incidental, or punitive damages. Client agrees to indemnify and hold Photographer harmless from and against any claims, liabilities, losses, and expenses arising from Client's breach of this Agreement or Client's negligence.

12. FORCE MAJEURE

Neither party shall be liable for failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disaster, government restrictions, pandemics, strikes, or other labor disturbances. If the event is cancelled due to force majeure, parties shall negotiate in good faith regarding rescheduling or refund of fees in proportion to services performed.

13. NOTICES

All notices required under this Agreement shall be in writing and delivered to the addresses or email addresses below. Notice shall be effective upon personal delivery, delivery by nationally recognized overnight carrier, or three (3) business days after deposit in the United States mail, postage prepaid.

14. AMENDMENTS, WAIVER, COUNTERPARTS

This Agreement may only be amended by a writing signed by both parties. No waiver of any provision shall be effective unless in writing and signed by the party waiving compliance. This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument.

15. GOVERNING LAW, ENTIRE AGREEMENT, SEVERABILITY

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Ceremony Location is situated. This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior understandings and agreements, oral or written. If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.

MISCELLANEOUS

Venue logistics, shot list preferences, and any additional terms agreed between the parties shall be attached hereto as an addendum and signed by both parties to form part of this Agreement.
