WEEKLY PAYMENT AGREEMENT

This Weekly Payment Agreement (Agreement) is made effective as of by and between the parties identified below.

Recitals

WHEREAS, Payor owes or will owe to Payee the principal sum of $ (Principal), and the parties desire to set forth the terms by which Payor will make weekly payments toward that obligation.

Payment Terms

1. Payment Amount: Payor shall pay to Payee weekly installments of $ until the Principal, together with any accrued interest and permitted fees, is paid in full.

2. Number of Payments: The parties estimate the number of weekly payments as (may be adjusted if prepayments or partial payments occur).

3. Payment Start Date: First payment due on and thereafter weekly on the same day of each week, or as otherwise agreed in writing.

4. Interest: Interest shall accrue on the unpaid Principal at the rate of per annum, calculated on a 365-day year basis, unless otherwise stated herein.

Application of Payments; Fees

Payments received will be applied first to accrued interest, then to fees, and then to Principal. Payee may, at its election, apply any partial payment to the oldest outstanding amounts.

Late Fee: If any weekly payment is not received within days of its due date, Payor shall pay a late fee of $ or of the overdue payment, whichever is greater.

Default and Remedies

1. Default: An event of default occurs if Payor fails to make any scheduled payment within the grace period, becomes insolvent, makes an assignment for the benefit of creditors, or otherwise breaches any material obligation under this Agreement.

2. Remedies: Upon default, Payee may declare all unpaid Principal and accrued interest immediately due and payable, pursue collection, recover costs and expenses (including reasonable attorneys' fees), and exercise any other rights available at law or equity.

Security (If Applicable)

If this Agreement is secured, the security interest, collateral description, and perfection steps shall be set forth and attached as an addendum. Absent a separate security agreement, this Agreement is unsecured.
