Supplier's sole obligation under this warranty shall be repair or replacement at Supplier's option. This warranty does not cover damage due to improper installation by third parties, abuse, or acts of God.

Cancellation by Purchaser prior to manufacture may result in forfeiture of deposit and payment of reasonable manufacturing and restocking charges. Returns of custom products are not accepted except by written agreement; off-the-shelf items may be subject to a restocking fee.

Default, Remedies, Limitation of Liability

If Purchaser fails to pay amounts when due or otherwise materially breaches this Order, Supplier may suspend performance, retain deposits, and pursue all remedies available at law or equity, including collection of costs and attorneys' fees. Supplier's aggregate liability for breach, negligence, or strict liability shall not exceed the purchase price paid for the specific goods giving rise to the claim. Neither party shall be liable for consequential or punitive damages except for willful misconduct.
