What the Winery Tour Agreement Covers

A Winery Tour Agreement is a written contract that documents the terms governing a commercial winery visit, tasting, or guided tour. It typically identifies the host and the guest parties, describes the scheduled tour date and itinerary, specifies fees, deposits and cancellation terms, and records safety and alcohol-consumption policies. The agreement also includes liability waivers, medical and accessibility disclosures where appropriate, and signature blocks for all parties. Properly drafted, it reduces disputes, clarifies expectations, and creates a record suitable for electronic signing and secure retention in compliance with applicable U.S. laws.

Why Use a Formal Winery Tour Agreement

A clear agreement allocates risk, documents consent to alcohol service and property access, and creates enforceable terms for fees, cancellations, and conduct. It helps operators meet regulatory obligations and protect guests and staff.

Why Use a Formal Winery Tour Agreement

Who Typically Completes a Winery Tour Agreement

Operators, event coordinators, and guests all rely on the agreement to document expectations and consent before a tour.

  • Winery operators and tasting room managers who book public or private tours and need liability protection and payment terms.
  • Event planners and third-party tour operators coordinating group visits, vendor access, and special-event logistics.
  • Individual guests or corporate bookers providing attendee lists, age verification, and emergency contact information.

Use the agreement whenever guests visit private vineyard property, participate in tastings, or when the operator requires deposits or age verification.

Step-by-Step: How to Complete and Execute the Agreement

Follow these sequential steps to prepare, confirm, and finalize a Winery Tour Agreement for a scheduled visit.

  • 01
Prepare the Draft: Populate tour details, fees, and safety clauses before sending to guests.
  • 02
Collect Attendee Data: Request full names, ages, and emergency contacts from the booker.
  • 03
Add Authentication: Require email verification or SMS code for primary signers as needed.
  • 04
Obtain Signatures: Capture all required signatures, dates, and witness or notary steps if applicable.

Essential Clauses to Include in a Professional Agreement

A comprehensive Winery Tour Agreement balances operational needs with legal protections; include these core clauses to make the document effective and defensible.

Tour Description

Describe itinerary, duration, meeting location, and any special activities so expectations are explicit and measurable.

Payment Terms

Specify total cost, deposit amount, payment method, due dates, and any handling fees for refunds or chargebacks.

Cancellation Policy

Define deadlines for refunds or credits and any forfeiture conditions to reduce booking disputes.

Liability Waiver

Include clear language releasing the host from ordinary negligence where permitted and describing participant responsibilities.

Alcohol Conduct

State age requirements, service limits, and consequences for intoxication, including removal or extra charges.

Emergency Procedures

List emergency contact, nearest medical facility, and procedures for accidents or medical issues during the tour.

Security and Compliance Basics for Electronic Agreements

In-Transit Encryption: TLS 1.2/1.3
At-Rest Encryption: AES-256 encryption
Audit Trail: Timestamps and IP logs
HIPAA Support: BAA available
Legal Compliance: ESIGN and UETA
FDA Records: 21 CFR Part 11

Legal and Financial Risks of an Incomplete Agreement

Contract Invalidity: Ambiguous terms risk unenforceability
Liability Exposure: Incomplete waivers increase host risk
Regulatory Fines: Age-verification failures may prompt penalties
Refund Disputes: Vague cancellation clauses cause chargebacks
Tax Consequences: Poor records can impede audits
I-9/Employment: Staff documentation breaches incur fines

Common Mistakes to Avoid

  • Failing to verify attendee age ahead of service increases legal exposure and may require last-minute cancellations or fines.
  • Using vague refund or cancellation language leads to disputes; specify exact deadlines and dollar amounts to reduce uncertainty.
  • Relying on handwritten waivers without retaining a reproducible record can make enforcement and audit defense difficult.
  • Not capturing emergency contact or medical information where required for safety protocols can delay response and escalate liability.

  • Host requires a 50% deposit to reserve the weekend slot.
  • The agreement specifies catering access, a damage deposit, and an emergency contact procedure to protect both host and organizer in case of last-minute cancellations or incidents.

Public Group Tour

An operator runs a scheduled weekend tour for walk-in guests and requests electronic waivers.

  • Guests sign waivers and confirm emergency contacts on arrival via tablet.
  • The operator retains digital records for seven years, enforces a 24-hour cancellation policy, and captures proof of age before service to comply with state alcohol laws.
