What a Winter Storage Agreement Covers

A Winter Storage Agreement is a seasonal contract between a storage provider and the owner of personal property (boats, RVs, vehicles, trailers, or equipment) that defines the terms for off-season storage. It sets the storage period, location, access rules, fees and deposit amounts, responsibility for insurance, permitted uses while stored, and the provider's lien and disposal rights for unpaid charges. The agreement clarifies liability for damage, outlines customer obligations for preparations and winterization, and records identifying details of the stored property to avoid later disputes.

Why Use a Winter Storage Agreement

A clear written agreement reduces disputes by documenting each party’s responsibilities, payment terms, insurance expectations, and the facility’s rights on default. It protects both owner and provider by allocating risk, enabling consistent enforcement of lien and collection procedures, and making operational expectations explicit throughout the off-season.

Why Use a Winter Storage Agreement

Who Typically Uses This Agreement

The agreement helps each party verify identity, establish payment and insurance obligations, and set clear remedies for loss, damage, or nonpayment.

  • Facility operators and marina managers who need a consistent contract to manage liability and lien processes.
  • Owners of boats, RVs, trailers, or seasonal equipment who need written proof of storage terms and access rules.
  • Third-party insurers and legal counsel who rely on documented terms for claims or dispute resolution.

Common Mistakes to Avoid

  • Failing to include a clear, signed description of the stored item often causes ownership or damage disputes later.
  • Accepting verbal promises about insurance without a written certificate leaves the facility exposed to uncovered loss claims.
  • Using vague lien or disposal language that does not follow state statute can make enforcement impossible or subject to penalties.
  • Neglecting to collect and date proof of condition at intake reduces chances of prevailing in damage claims or insurance disputes.

Risks and Consequences of an Incorrect Agreement

Unenforceable Lien: Loss of collection remedy
Insurance Gaps: Owner or provider bears unexpected costs
Liability Exposure: Increased legal claims risk
Regulatory Fines: State penalties for improper disposition
Reputational Harm: Customer disputes and negative publicity
Operational Disruption: Delays in removal or sale of property
