What a Work From Home Agreement Is and Why It Matters

A Work From Home Agreement is a written contract setting expectations, responsibilities, and conditions when an employee performs job duties remotely. It documents working hours, equipment and expense responsibilities, confidentiality and data security obligations, reporting and supervision arrangements, and any special compliance requirements such as HIPAA or industry-specific rules. The agreement clarifies employer and employee duties, reduces misunderstandings, and creates an auditable record for HR, payroll, and legal reviews while supporting consistent remote work administration across locations.

Why Using a Formal Work From Home Agreement Helps Employers and Employees

A formal agreement reduces ambiguity about hours, compensation, data security, and equipment ownership, and provides a written basis for handling expenses, performance expectations, and policy compliance under state and federal law.

Why Using a Formal Work From Home Agreement Helps Employers and Employees

Who Typically Completes a Work From Home Agreement

Employers, HR teams, hiring managers, and remote employees commonly complete Work From Home Agreements to document expectations and approvals before remote work begins.

  • HR teams and Talent Managers who administer policy and store completed agreements for compliance and audit purposes.
  • Hiring Managers who approve remote arrangements and track equipment allocation and performance expectations.
  • Employees who accept terms, acknowledge policies, and provide required contact and equipment information.

Use a signed agreement when approving recurring remote work, temporary telework arrangements, or as part of onboarding for remote hires to create a clear compliance trail.

Who Signs and Approves These Agreements

Employee

The employee fills in personal and worksite details, agrees to security and performance terms, and signs to confirm consent to the remote-work conditions described in the agreement.

Authorized Manager

A manager or HR representative reviews eligibility, approves the arrangement, and signs for the employer to confirm equipment, supervision, and any expense or liability provisions.

Core Sections to Include in a Professional Agreement

Include clear, enforceable clauses that establish the scope of remote work, expectations, and protections for both parties.

Work Scope

Describe duties, expected output, core hours, timekeeping, and on-call or availability requirements so both parties have a shared understanding of job performance.

Equipment and Expenses

Specify who provides devices, software, connectivity, maintenance responsibilities, and reimbursement procedures for approved business expenses.

Data Security

Detail required security measures, encryption, acceptable devices, and procedures for reporting breaches or loss of employer data.

Confidentiality

Incorporate confidentiality, IP assignment, and nondisclosure language consistent with existing employment agreements and industry rules.

Compliance

Address applicable legal obligations such as HIPAA for healthcare data, FERPA for education records, and recordkeeping duties where relevant.

Termination and Review

State conditions for revocation, return of equipment, final payables, and periodic review intervals for updating the agreement.

Common Mistakes to Avoid When Preparing an Agreement

  • Vague scope language that fails to define core hours, deliverables, or performance metrics, leading to disputes and enforcement difficulties.
  • No equipment inventory or responsibility clause, which causes uncertainty about repairs, replacements, and liability for lost or damaged devices.
  • Omitting data security and privacy obligations, increasing the risk of breaches, regulatory exposure, and inconsistent practices across remote staff.
  • Failing to address tax, labor law, or cross-jurisdictional rules when employees work outside the employer's primary state of operation.
