What the Work Visa Declaration Form Is

A Work Visa Declaration Form is a written statement used by employers, sponsoring organizations, or applicants to confirm employment terms and immigration-related facts needed for a nonimmigrant or immigrant work visa petition. It typically records the worker's identity, visa classification, job title, duties, salary or compensation, start date, and any employer attestations about the position. The form can support USCIS petitions (for example, an I-129 employer statement) or serve as a supporting affidavit for consular processing, and it is often retained with onboarding and I-9 records.

Why a Clear Declaration Matters

A concise, accurate declaration reduces delays, clarifies employer and employee obligations, and strengthens documentation submitted to USCIS or consular posts. Properly completed forms help with I-9 compliance, internal HR records, and audits while creating a consistent record for visa adjudicators and legal review.

Why a Clear Declaration Matters

Who Typically Prepares and Signs This Form

Employers, immigration counsel, HR teams, and applicants commonly prepare work visa declarations to support visa petitions and onboarding records.

  • Immigration attorneys preparing petition support statements for USCIS or consular review
  • HR or talent acquisition staff documenting offer terms and verifying eligibility
  • International employees or sponsored workers supplying personal and passport details

Each party has distinct responsibilities: employers supply job and payroll attestations; applicants confirm identity and consent; attorneys ensure legal sufficiency.

Core Sections to Include in a Professional Declaration

A complete Work Visa Declaration Form organizes identity, employment facts, legal attestations, and signatures so reviewers can verify eligibility quickly.

Applicant Identity

Full legal name, date of birth, passport number, and country of citizenship; include exact spellings to match government ID.

Visa Classification

Specify the visa type (for example, H-1B, L-1, O-1, TN, or immigrant classification) and relevant petition form reference.

Position Details

Job title, duties summary, work location, standard hours, and whether the role is full-time or part-time.

Compensation

Salary or wage, pay frequency, and any benefits that affect prevailing wage or Labor Condition Application compliance.

Attestations

Employer statements about bona fide job, compliance with immigration rules, and accuracy of submitted facts under penalty of perjury.

Signature Block

Typed or signed name, title, date, and capacity (employer, authorized representative, or applicant); include notarization or witness fields if required.

Security and Compliance Considerations

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Timestamped event logs and signer metadata
HIPAA BAA: BAA required for PHI-containing records
ESIGN/UETA: Meets ESIGN and UETA signature standards
Access Controls: Role-based permissions and SSO options
Certifications: SOC 2 Type II and ISO 27001 available

Step-by-Step: Filling Out the Form

Follow a consistent sequence to reduce errors and ensure the form supports petition or onboarding needs.

  • 01
    1. Gather Documents: Collect passport, offer letter, and prior visas.
  • 02
    2. Complete Identity Fields: Enter names, DOB, passport details exactly.
  • 03
    3. Add Employment Details: Record title, duties, location, and salary.
  • 04
    4. Review and Sign: Verify all entries, then sign in presence of notary if required.

Where a Completed Declaration Typically Goes

A finalized declaration is routed to the parties who need it: employer files, counsel, immigration authorities, and personnel records.

  • Employer HR: Retains form in the employee personnel and I-9 file.
  • Immigration Counsel: Includes form with USCIS petitions or consular packets.
  • USCIS/Consulate: Used as supporting documentation for adjudication.
  • Employee: Keeps a signed copy for personal records.

Typical Digital Workflow Settings

Configure the online workflow to reduce manual steps and preserve auditability across document routing.

Field Mapping Auto-fill name | passport | dates
Conditional Fields Show visa-specific fields when selected
Signer Roles Employer | Applicant | Attorney
Authentication Method Email link | SMS code | KBA
Retention Policy Auto-archive to HR folder

Digital Signing and Format Requirements

Use a platform that supports PDF/DOCX uploads, audit trails, and conditional fields to capture structured immigration data.

  • File Types: PDF | DOCX | XLSX supported
  • Integrations: Connectors for HR and cloud storage
  • Authentication: Email, SMS, KBA, or SSO

Ensure the provider supports ESIGN/UETA compliance, offers secure storage, and can produce tamper-evident signed PDFs and complete audit reports for immigration and audit purposes.

Key Penalties and Risks for Errors

I-9 Penalties: $281–$2,789 per violation
Immigration Fraud: Denial, fines, or removal
Tax Withholding: Backup withholding 24% if TIN missing
Document Rejection: Missing signatures delay adjudication
Civil Liability: Employer sanctions or contract disputes
Data Breach: HIPAA/CCPA penalties if PHI exposed

Common Mistakes to Avoid

  • Using a nickname or shortened name that does not match the passport or government ID, which can create identity mismatch issues during adjudication.
  • Failing to include a complete job description or salary details, causing requests for evidence that delay petition approval and create extra legal fees.
  • Signing before required notarization or witness presence, which can render affidavits or attestations invalid for consular or USCIS use.
  • Relying on inconsistent dates across documents (offer letter, LCA, declaration), leading to contradictory evidence and potential denials.

Cross-check passport name spelling and passport expiration dates before filing to avoid identity or passport validity issues during adjudication.
Use Consistent Dates
Align start dates across offer letters, LCA (if applicable), and the declaration to prevent contradictory evidence.
Document Versioning
Track revisions and keep a signed original; store copies in the personnel and immigration files for audit readiness.
Authentication Method
Choose signer authentication appropriate to the risk level — stronger methods reduce later disputes about attribution.
