Recitals and Effective Date

This Worker Levy Agreement (the "Agreement") is entered into by the Employer and the Worker to authorize and govern the withholding and remittance of levy deductions from the Worker’s wages in accordance with the terms set forth below. Effective Date: .

Definitions

For the purposes of this Agreement: "Levy" means the amount withheld from gross wages pursuant to this Agreement; "Net Pay" means gross wages less legally mandated deductions; "Pay Period" means the Employer's regular payroll period.

Levy Authorization and Details

The Worker authorizes the Employer to withhold from the Worker’s wages the levy described below and to remit such amounts to the Payee named above. The parties agree the levy shall be applied as follows:

Remittance, Accounting, and Reporting

The Employer shall remit withheld levy amounts to the Payee by the remittance method identified above. Remittances shall be made no later than business days after each payroll payment. The Employer will provide a remittance report that includes the Worker name, pay period, gross wages, amount withheld, and Payee reference for each remittance.

Late Remittance, Errors and Correction

If the Employer fails to remit withheld amounts when due, the Employer shall be responsible for any late fees, interest, and administrative charges assessed by the Payee. Interest on late remittances shall accrue at the rate of % per month (or the maximum lawful rate if less). The Employer shall correct any withholding errors promptly and provide an accounting to the Worker and Payee within business days of discovery.

Records, Audit, and Confidentiality

The Employer shall maintain payroll and remittance records relating to the levy for a minimum of years and shall permit the Payee or its designee to audit such records upon reasonable notice during normal business hours. All personal and payroll information exchanged under this Agreement shall be treated as confidential and used solely for the purposes of effecting the levy.

Indemnification and Liability

The Employer shall indemnify and hold harmless the Payee and the Worker from any claims, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from the Employer’s failure to withhold, remit, or report levy amounts as required by this Agreement. The Worker releases the Employer from liability for amounts properly withheld and remitted in accordance with this Agreement.

Termination and Amendment

This Agreement may be terminated by mutual written agreement of the parties or by either party upon days written notice, provided that any amounts withheld prior to termination shall be remitted in accordance with this Agreement. Amendments must be in writing and signed by both parties.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction identified below. The parties agree to attempt good-faith negotiation to resolve disputes; if unresolved within days, disputes shall be resolved by binding arbitration unless otherwise required by law.

Notices

All notices required or permitted under this Agreement shall be in writing and delivered to the addresses set forth above or to such other address as a party designates in writing. Notice shall be effective upon receipt.
