Waiver and Release

Effective Date of Waiver:

The undersigned Applicant, in consideration of engagement by the Employer named above, hereby acknowledges and agrees as follows:

1. Representation of Status. The Applicant represents that the Applicant performs services as an independent contractor or is otherwise an owner/operator or person whose employment classification does not require the Employer to obtain workers' compensation coverage under applicable law. Applicant affirms that such classification is accurate and complete for the period of this waiver.

2. Waiver of Employer Coverage. To the maximum extent permitted by applicable law, the Applicant knowingly and voluntarily waives any right to workers' compensation benefits or employer-funded medical or wage-loss benefits from the Employer for any injury, occupational disease, or death arising out of or in the course of performing the described services during the Effective Date of Waiver. Applicant understands that this waiver is specific to the relationship with the Employer and does not affect rights under other coverage arranged by the Applicant.

3. Assumption of Responsibility and Indemnity. The Applicant agrees to assume responsibility for obtaining and maintaining any personal medical, disability, or liability insurance deemed necessary by the Applicant. The Applicant shall defend, indemnify, and hold harmless the Employer, its officers, directors, employees, and agents from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to personal injury, occupational illness, or death claimed by or on behalf of the Applicant, except to the extent caused by the Employer's gross negligence or intentional misconduct.

4. Limitations and Legal Compliance. This Waiver is intended to be interpreted in accordance with applicable state and federal law. Nothing in this Waiver shall be construed to waive rights that cannot be waived as a matter of law. If any provision of this Waiver is determined to be unenforceable under applicable law, that provision will be severed and the remainder of this Waiver will remain in full force and effect.

Exclusions and Special Conditions

The waiver expressly excludes claims arising from Employer's intentional torts and does not apply to any statutory benefits or protections that the Applicant is entitled to under law notwithstanding any private agreement. Applicant further acknowledges that this Waiver does not modify or limit the Employer's obligations under any other mandatory statutory insurance for which waiver is not permitted.

What the Workers' Compensation Coverage Waiver Is

A Workers' Compensation Coverage Waiver is a written document in which an employee or contractor acknowledges and agrees to limit or waive some claims to workers' compensation benefits or declares that they are not covered by an employer's workers' compensation policy. The waiver is intended to clarify insurance status, allocate risk, and document acknowledgements when parties agree to alternative arrangements such as evidence of independent contractor status, private insurance, or indemnity shifts. Enforceability varies by jurisdiction and public-policy limits often restrict pre-injury waivers of core statutory benefits.

Why this Waiver Matters for Risk and Documentation

A clear waiver documents parties' expectations about coverage, supports compliance reviews, and can reduce disputes about whether workers' compensation applies to a given relationship. It also creates a written record employers, insurers, and regulators can examine when claims arise.

Why this Waiver Matters for Risk and Documentation

Who Commonly Uses a Workers' Compensation Coverage Waiver

Use the waiver only after confirming local law permits such an agreement and after consulting your insurer or legal counsel; many states do not permit pre-injury surrender of statutory workers' compensation rights.

  • Small and mid-size employers verifying alternate coverage for contract workers
  • Staffing agencies documenting that supplied workers remain covered by the agency
  • Independent contractors confirming they carry their own occupational insurance

Step-by-Step: How to Complete the Waiver

Follow these sequential steps to prepare, review, and finalize a Workers' Compensation Coverage Waiver so it reflects intent and reduces enforceability risk.

  • 01
Prepare the draft: Describe parties, coverage status, and the precise scope of any waiver or acknowledgment.
  • 02
Verify legal constraints: Confirm state law permits the waiver; many jurisdictions prohibit pre-injury surrender of statutory benefits.
  • 03
Confirm insurer consent: Notify the employer's insurer and record any policyholder restrictions or endorsements.
  • 04
Sign and retain: Execute signatures and store the signed document with HR and claims files; retain per legal retention rules.

Essential Elements of a Professional Coverage Waiver

A well-constructed waiver communicates coverage decisions, assigns responsibilities, and preserves evidence of consent while minimizing ambiguity that can undermine enforcement.

Parties Identified

Full legal names and contact details for employer, worker, and any third-party insurer; correct identification ensures parties can be located and liabilities allocated.

Clear Coverage Statement

A concise description of whether the worker is covered by the employer's workers' compensation policy or maintains their own equivalent coverage, including policy identifiers.

Scope and Limits

Precisely state which rights are acknowledged or waived and any limitations or exceptions; avoid vague phrases like 'all rights'.

Consideration Recited

If the waiver is part of a broader exchange, describe the consideration (payment, contract award, assignment) to show mutuality and intent.

Signature and Date

Signature blocks for all parties with printed name, title, and date; include witness or notary sections if required by jurisdiction.

Acknowledgements

Confirm the signer has read the document, had opportunity to consult counsel, and understands the consequences of the waiver.

Key Data Points to Capture on the Form

Employer: Legal name
Worker: Full legal name
Policy: Insurer and number
Dates: Effective / end dates
Classification: Employment status
Signatures: Signed and dated

Common Preparation Pitfalls to Avoid

  • Using vague language about 'coverage' without policy identifiers, which creates ambiguity at claim time and invites dispute.
  • Failing to confirm state law or insurer approval before relying on the waiver, risking unenforceability and regulatory penalties.
  • Collecting only initials or an email agreement when a full signature and dated block are required for evidentiary value.
  • Storing signed originals separately from personnel or claims files, which impedes timely production during audits or litigation.

Risks and Consequences of an Improper Waiver

Unenforceability: Statute invalidation
Regulatory Fines: State penalties
Claim Liability: Employer exposure
Insurance Denial: Coverage dispute
Reputational Harm: Public claims
Litigation Costs: Attorney fees

Where to Send and File the Signed Waiver

After execution, route copies to the key stakeholders listed below so records are complete and accessible for claims, audits, and regulatory review.

  • Employer HR File: Retain signed executed copy in the employee or contractor personnel file.
  • Insurance Carrier: Provide insurer with a copy when requested or when coverage is altered.
  • Claims Folder: Attach to electronic or paper claim file if an injury occurs.
  • Legal Counsel: Share with counsel for review when drafting or prior to enforcement.

How to Configure an Online Waiver Workflow

When digitizing the waiver, set authentication, conditional fields, and retention rules to match legal and insurer requirements.

Field Recommended setting
Authentication Email + SMS code or higher
Required Fields Name, classification, policy info, signature
Conditional Logic Show policy fields only if worker indicates private coverage
Retention Retain per company policy and legal minimums

eSigning and Integration Considerations

Ensure the chosen solution meets any required compliance frameworks (for example HIPAA BAA if health data is included) and that signed PDFs are preserved in an immutable format.

  • Authentication: Email, SMS, KBA
  • Audit Trail: IP, timestamp, action log
  • Integrations: Salesforce, NetSuite, Google Workspace
