Waiver, Release and Indemnity

By initialing and signing below, Applicant acknowledges and agrees that Applicant is not an employee of Employer for the purposes of workers' compensation coverage and hereby expressly and voluntarily WAIVES any claim to workers' compensation benefits from Employer arising out of or in connection with the services performed under this engagement, except to the extent such a waiver is prohibited by applicable law.

Applicant further releases and forever discharges Employer, its officers, directors, agents and employees from any and all claims, liabilities, demands and causes of action of every nature and description, whether known or unknown, arising out of bodily injury, death or property damage occurring in connection with the services provided, except for willful misconduct or gross negligence of Employer.

Applicant agrees to indemnify, defend and hold Employer harmless from and against any and all claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of Applicant's acts, omissions or breach of this Waiver.

Exclusions and Limitations

The waiver does not modify any statutory obligations that cannot be waived by law. Employer retains no obligation to provide medical treatment, wage replacement or death benefits to Applicant unless required by applicable statute. Applicant acknowledges the following specific exclusions:

  • Claims for willful misconduct or gross negligence by Employer are not released by this Waiver.
  • Any statutory benefits mandated by jurisdictional law that cannot be waived remain available as provided by law.
  • This Waiver does not bar claims against parties other than Employer who may be responsible for Applicant's injury.

Beneficiary Designation

In the event of Applicant's death resulting from work performed for Employer during the engagement period, any benefits payable under a policy carried by Applicant shall be distributed to the beneficiary designated below:

Claims Reporting & Documentation

Applicant shall promptly report any injury, illness or incident arising out of or in connection with the engagement to Employer and shall cooperate in any related investigation. Failure to report an incident may affect any claim for benefits under Applicant's own policy.

Representations and Certifications

Applicant represents and certifies that all information provided in this Waiver is true and complete. Applicant affirms that Applicant is authorized to enter into this Waiver on behalf of the entity identified above (if applicable) and that no other person has authority to alter the terms of this Waiver except by a written instrument signed by both Employer and Applicant.

This Waiver shall be governed by and construed in accordance with the laws of the State of , without regard to its conflict of law principles.
