Workplace ADA Policy (Employer Policy)

It is the Employer's policy to provide equal employment opportunities to qualified individuals with disabilities and to provide reasonable accommodation to the known physical or mental limitations of otherwise qualified applicants and employees, unless doing so would impose an undue hardship on the operation of the Employer's business.

"Disability" is defined broadly to include physical or mental impairments that substantially limit one or more major life activities. "Reasonable accommodation" includes modifications or adjustments to the work environment, job restructuring, modified schedules, assistive devices, or leave as required by law.

Employees or applicants who request an accommodation should contact the Employer's accommodation coordinator: Name:   Phone:   Email/Department: .

Upon receipt of a request, the Employer will engage in a timely, good faith interactive process with the individual to identify effective reasonable accommodations. The Employer may request reasonable documentation of disability and limitation when necessary to evaluate the request, and will provide a written accommodation determination.

When appropriate, the Employer may request documentation from a health care provider that is sufficient to establish the existence of a disability and the functional limitations relevant to the requested accommodation. Such documentation will be treated as confidential medical information.

The Employer will consider whether a requested accommodation would impose an undue hardship on the operation of the business, taking into account the nature and cost of the accommodation and the Employer's financial resources. The Employer will evaluate essential job functions when determining whether an individual is otherwise qualified and whether an accommodation would be reasonable.

The Employer prohibits retaliation against any individual who requests an accommodation, participates in the interactive process, or files a complaint alleging disability discrimination. Any instance of retaliation should be reported immediately to the accommodation coordinator or other authorized representative.

The Employer will provide training to supervisors and human resources personnel regarding recognition of accommodation requests, the interactive process, confidentiality of medical information, and non-retaliation. Employees are responsible for cooperating in the interactive process and providing requested information in a timely manner.

Records related to accommodation requests and medical documentation will be retained for a minimum of years in a secure manner consistent with applicable law.

Any amendment to this Agreement must be in writing and signed by authorized representatives of both parties.

Miscellaneous Provisions

If any provision of this Agreement is held invalid or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect. Neither party may assign this Agreement without the prior written consent of the other, except that the Employer may assign this Agreement to an affiliate or successor in interest without such consent upon notice.

What the Workplace ADA Policy Template Is and When to Use It

A Workplace ADA Policy Template is a standardized employer document that sets out nondiscrimination commitments, procedures for requesting reasonable accommodations, and the interactive process used to evaluate requests under the Americans with Disabilities Act (ADA). The template provides model language for notice, confidentiality, roles (ADA coordinator or HR), documentation expectations, timelines for responses, and sample accommodation examples. Organizations adapt the template to their size, industry, and applicable state or local disability laws while preserving required ADA protections and procedural safeguards for employees and applicants.

Why a Clear ADA Policy Matters for Employers

A formal policy reduces legal risk, clarifies employee rights and employer responsibilities, and streamlines accommodation handling. It documents consistent procedures, supports compliance with federal law (42 U.S.C. §12101 et seq.), and creates an auditable record of interactive-process decisions.

Why a Clear ADA Policy Matters for Employers

Who Typically Uses This Template and How It’s Applied

Use the template to establish consistent accommodation procedures across HR, managers, and employee representatives.

  • Human resources teams responsible for drafting and maintaining policy and training materials.
  • Supervisors and people managers who respond to accommodation requests and implement solutions.
  • Employees and applicants who need clear instructions for requesting accommodations and understanding rights.

The template supports internal training, case documentation, and can be adapted for industry- or state-specific obligations.

Practical Tips for Accurate, Efficient Policy Completion

Adopt consistent drafting, approval, and distribution habits to reduce disputes and speed response to accommodation requests.

Use Clear, Simple Language
Write policy text in plain English so employees understand rights and steps; avoid legalese that may create confusion during interactive processes.
Designate an ADA Coordinator
Name a single point of contact with backup and publish their contact details to centralize requests and ensure timely responses.
Keep Medical Records Separate
Segregate medical and accommodation documentation from general personnel files and restrict access to authorized staff only to help satisfy privacy requirements.
Periodically Review
Review the policy annually or when state law changes, and document approvals to demonstrate ongoing compliance and continuous improvement.

Common Mistakes to Avoid When Preparing an ADA Policy

  • Vague request process that leaves employees unsure how to seek accommodations and causes delays in handling matters.
  • Overcollecting medical information or failing to keep documents confidential, which increases legal and privacy risk.
  • Not assigning clear responsibility for decisions, producing inconsistent outcomes and potential disparate treatment claims.
  • Neglecting to tailor the policy for state-specific laws such as FEHA (California) or NYHRL (New York).

Risks and Potential Consequences of an Inadequate ADA Policy

EEOC Complaint: Investigation and potential mediation or litigation exposure
Civil Liability: Damages and attorneys’ fees from discrimination suits
Regulatory Scrutiny: State enforcement actions where local laws exceed federal standards
HIPAA Breach Risk: Penalties if medical information mishandled (where HIPAA applies)
Operational Impact: Lost productivity from inconsistent accommodation processes
Reputational Harm: Employee distrust and negative public perception
