WORKPLACE ALCOHOL POLICY AND AGREEMENT

WHEREAS: Employer Name: is engaged in business and operates facilities where safety, productivity, and the health of employees are priorities;

WHEREAS: Employee Name: is employed by the Employer and will perform duties subject to the terms of this Workplace Alcohol Policy and Agreement (the "Policy");

WHEREAS the parties desire to establish clear standards governing alcohol use, testing, assistance, discipline, and confidentiality to protect workplace safety and comply with applicable law.

Scope of Work

This Policy applies to all employees while on Employer premises, during work hours, while operating Employer vehicles or equipment, and at Employer-sponsored events unless otherwise stated. Describe job functions or areas particularly covered by this policy:

Policy Statement

The Employer maintains a workplace free from the adverse effects of alcohol. Employees are prohibited from reporting to work or remaining at work while under the influence of alcohol, from consuming alcohol on duty, and from possessing alcohol in restricted areas. Limited, employer-authorized consumption at specified events is permitted only with prior written authorization from management and in accordance with this Policy.

Prohibited Conduct

The following conduct is prohibited:

On-duty consumption of alcohol.

Possession of alcohol in restricted areas or during safety-sensitive tasks.

Reporting to work or remaining at work under the influence of alcohol.

Refusal to submit to authorized testing or investigation related to alcohol use.

Testing and Investigation

Employees may be required to submit to alcohol testing where there is reasonable suspicion of impairment, following an accident/incident that implicates alcohol as a contributing factor, or pursuant to random testing programs where permitted by law and this Policy. Testing procedures will be carried out in a manner that preserves the dignity and privacy of the employee and meets objective standards for accuracy.

Assistance, Rehabilitation and Payment Terms

The Employer may provide or refer employees to an assistance or rehabilitation program. Participation may be a condition of continued employment where appropriate. The following financial terms apply to employer-funded assistance and employee reimbursements:

Unless otherwise agreed in writing, an employee who receives employer-funded treatment and resigns or is terminated for cause within months may be required to reimburse a pro rata portion of such costs in accordance with the repayment schedule above.

Discipline and Remedies

Violations of this Policy will result in disciplinary action up to and including suspension and termination. Disciplinary action will be applied in a manner consistent with applicable law and the Employer’s disciplinary procedures. The Employer may consider voluntary participation in an approved assistance program in determining discipline, but participation does not preclude disciplinary measures where warranted.

Term and Termination

Either party may terminate this Agreement with written notice provided days prior to the intended termination date, subject to any contractual restrictions on termination.

Confidentiality; Records and Access

Access is limited to individuals with a legitimate need to know, such as Human Resources, occupational health professionals, and management with a direct need related to safety or compliance. Information will be retained and disclosed only as required or permitted by law, to protect safety, or with the employee’s written consent.

Governing Law; Entire Agreement

This Policy and Agreement shall be governed by and construed in accordance with the laws of the state identified as Governing State: , without regard to choice-of-law principles.

This Policy constitutes the entire agreement between the parties with respect to workplace alcohol rules and supersedes all prior understandings, whether written or oral, relating to the same subject matter.
