This Yacht Rental Agreement ("Agreement") is made effective as of between Owner Name: with Address: and Renter Name: with Address: .

WHEREAS, Owner is the lawful owner of the vessel described below and has the right to rent the vessel to third parties; and

WHEREAS, Renter desires to charter the vessel for recreational and lawful maritime use under the terms and conditions set forth in this Agreement; and

The Owner agrees to rent and the Renter agrees to charter the vessel for the period and purposes described below. The Renter shall use the vessel solely for lawful, recreational purposes within permitted cruising limits and shall not sublet the vessel without prior written consent of the Owner.

Payment Terms

Term and Termination

The rental term shall commence on and shall end on unless earlier terminated in accordance with this Agreement.

Either party may terminate this Agreement for material breach by the other party if the breach is not cured within the notice period provided above. Owner may terminate immediately for safety-related reasons, unseaworthiness, or if Renter engages in illegal activity.

Insurance and Damage

Renter shall be responsible for any loss or damage to the vessel and its equipment caused by Renter's negligence or breach; Owner shall be responsible for pre-existing defects. The security deposit will be applied to repair costs; any excess shall be invoiced to the Renter.

Use Restrictions, Safety and Seaworthiness

Renter represents that all operators hold required licenses, will comply with applicable laws, will not operate under the influence of alcohol or drugs, and will observe safety procedures. Owner represents that, to Owner's knowledge, the vessel is seaworthy and maintained consistent with industry standards at the commencement of the rental.

Indemnification and Limitation of Liability

Renter shall indemnify, defend and hold Owner harmless from all claims, liabilities, losses, costs and expenses (including reasonable attorneys' fees) arising out of Renter's use of the vessel, except to the extent caused by Owner's gross negligence or willful misconduct. In no event shall either party be liable for indirect, incidental or consequential damages.

Fuel, Provisions and Operating Costs

Renter shall return the vessel with fuel levels as agreed. Owner may charge reasonable costs for refueling, provisioning, repairs due to Renter's use, and for replacement of lost items.

Cancellation and Weather

If weather or safety conditions render the charter unsafe, Owner may cancel or alter the itinerary. Owner will use reasonable efforts to reschedule or refund amounts beyond fees incurred.

Confidentiality

Each party shall keep confidential and not disclose to any third party the proprietary business information, pricing, passenger manifests, and personal data relating to charter guests disclosed by the other party in connection with this Agreement, except as required by law. This obligation survives termination for a period of three (3) years.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction of , without regard to conflict of law principles.

Entire Agreement

This Agreement, including any attachments or addenda executed by the parties, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings and communications, whether oral or written.
