Whereas Organization Name: provides supervised educational, athletic, or recreational programs for minors; and

Whereas Participant and Parent/Guardian desire that Participant participate in the Program described above and understand the inherent risks associated with the activity; and

Whereas the parties intend for this document to set forth the terms of participation, payment obligations, release of liability, and emergency authorization.

Scope of Activity

Assumption of Risk; Waiver and Release

Acknowledgement: The undersigned acknowledges that participation in the Program involves risks including, but not limited to, physical injury, illness, property loss, or death. The undersigned voluntarily assumes all such risks. In consideration of Participant's participation, Parent/Guardian, on behalf of Participant and themselves, hereby releases, waives, discharges and covenants not to sue Organization, its officers, directors, employees, volunteers and agents (collectively, Released Parties) from any and all liability for any loss, damage, injury or death and any claim or demand therefor on account of injury, death or damage to person or property arising out of or related to Participant's participation in the Program, whether caused by the negligence of the Released Parties or otherwise.

Payment Terms

Late Fee:    Nonpayment may result in removal from the Program and collection efforts. All reasonable collection costs and attorney fees will be charged to the responsible party.

Termination for Cause: Organization may terminate Participant's participation for failure to comply with rules, nonpayment, or behavior that endangers Participant or others. Parent/Guardian may withdraw Participant in accordance with the notice period set forth above; refund eligibility is subject to the payment schedule and refund policy described in Payment Schedule.

Confidentiality and Privacy

Confidentiality: All nonpublic personal information exchanged in connection with the Program shall be treated as confidential by the parties and shall not be disclosed except as required by law or as necessary to provide emergency medical care or to administer Program logistics. Parent/Guardian consents to necessary disclosures to third-party vendors retained to provide services for the Program.

Indemnification

Parent/Guardian agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of Participant's acts or omissions while participating in the Program, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.

Governing Law; Entire Agreement

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to its conflict of law principles.

Entire Agreement: This document constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior negotiations, representations, or agreements, whether written or oral. Any amendment must be in writing and signed by both parties.
