To register online: • Follow the “Register Your Truck” link on our website. www.arb.ca.gov/drayagetruck To register by mail: • Download an application from our website or contact us for one via mail. • Complete and mail the application. Compliance labels: Labels are NOT mandatory. We are providing FREE compliance labels for trucks to aid in the identification of compliant trucks by ports and rail yards. Compliance labels can be requested by checking a box on the DTR application. WHAT ARE THE PENALTIES FOR NON-COMPLIANCE? The owner or operator of the vehicle can be subject to the following: • California Health and Safety Code, Sections 39674 (a) and (b) authorize civil penalties for the violation of the programs for the regulation of toxic air contaminants not to exceed one thousand dollars ($1,000.00) or not to exceed ten thousand dollars ($10,000.00) respectively, for each day in which the violation occurs • Suspension of vehicle registration • Possible criminal penalties as specified in the Health and Safety Code. Additionally, the regulation requires motor carriers to only dispatch drayage trucks to the ports and rail yards that meet regulatory emission standards and that are registered in the DTR. Motor carriers that dispatch noncompliant trucks are subject to penalties of up to $10,000 per day per violation. REGULATION TEXT The text of the regulation can be obtained through our website. Ver. BACKGROUND In 2007, the California Air Resources Board (ARB) passed a regulation to reduce emissions from drayage trucks operating at California’s ports and intermodal rail yards. The regulation applies to all ports and intermodal rail yards in California – see website for complete list. Note: The ports of L.A. and Long Beach have stricter requirements for trucks entering their facilities. A drayage truck is: • • • Class 8 (GVWR > 33,000lbs.) Diesel-Fueled On-Road Certain trucks are exempt from this regulation. They include: • • • • Dedicated-use vehicles Emergency vehicles Military tactical support Yard trucks Please visit our website for further information on exempted trucks. Note: All exempted trucks will be subject to the statewide bus and truck regulation. ENGINE MODEL YEAR EMISSION REQUIREMENTS Owners and operators of drayage trucks are required to do the following: By September 30, 2009: • Register trucks in the statewide Drayage Truck Registry (DTR).
