369 66 Interstate Transportation Of A Stolen Motor Vehicle 18 USC § 2312 Title 18, United States Code, Section 2312, makes it a Federal crime or offense for anyone to transport, or cause to be transported in interstate commerce, a stolen motor vehicle. The Defendant can be found guilty of that offense only if all of the following facts are proved beyond a reasonable doubt: First: That the Defendant transported, or caused to be transported, in interstate commerce, a stolen motor vehicle, as described in the indictment; and Second: That the Defendant did so willfully, and with knowledge that the mot or vehicle had been stolen. The word "stolen" includes any wrongful and dishonest taking of a motor vehicle with the intent to deprive the owner of the rights and benefits of ownership. It does not matter whether the Defendant stole the car or someone else did, but, to find the Defendant guilty you must find that the Defendant transported it or caused it to be transported, in interstate commerce, with knowledge that it had been stolen. The term "interstate commerce" means commerce between one state and another state, the District of Columbia, or any commonwealth, territory, or possession of the United States. If a motor vehicle is driven under its own power or otherwise transported across state lines from one state to another it has been transported in interstate commerce. ANNOTATIONS AND COMMENTS 18 USC § 2312 provides: Whoever transports in interstate commerce a motor vehicle knowing the same to have been stolen, [shall be guilty of an offense against the United States].
