Agreement of Adult Child Not to Contest Will of Parent Agreement made on the ______________________________ (date) , between _______________________________ (Name of Parent) of _____________________________ ______________________________________________________________________________ (street address, city, county, state, zip code) , referred to herein as Parent , and ________________________________ (Name of Adult Child) , of _______________________ ______________________________________________________________________________ (street address, city, county, state, zip code) , referred to herein as Adult Child . Whereas, Parent shall not (or has not) include (or included) Adult Child in his Last Will and Testament, but desires to provide for the future comfort and well being of Adult Child at his death by means of a life insurance trust; and Whereas, Parent and Adult Child desire to enter into an agreement that in consideration of said life insurance trust, Adult Child will not contest Parent’s will or file a claim against Parent’s Estate; 1. Agreement Not to Contest Adult Child agrees not to contest the Will of Parent in any court, and to allow the same to be properly probated without contest on his/her part. 2. Claims against Estate Adult Child agrees not to present any claims against the estate of Parent of any kind whatsoever. 3. Payment of Consideration In consideration of the foregoing promises of Adult Child , Parent shall execute in favor of Adult Child , contemporaneously with the signing of this Agreement, an Irrevocable Trust Funded by Life Insurance in the form and amount set forth in Exhibit A . 4. Understanding of Rights Released Adult Child represents and agrees that he/she has been informed as to the approximate size of Parent’s estate; that the assets of the estate are well known to him/her ; that this release is voluntarily given; that he/she is not under coercion from any source; and that the Trust in Section 3 of this Agreement has been executed contemporaneously with the signing of this Agreement.
