Agreement with Church Choir DirectorPage 1 of 4 Agreement with Church Choir Director Agreement made this day of , 20 , between , a Sec. 501(c)(3) organization of the Internal (Name of Church) Revenue Code, a nonprofit Church Corporation organized and existing under the laws of , with its principal office located at , (State) (Street Address) , referred to herein Church, and (City, State, Zip Code) , of , referred (Name of Choir Director) (Street Address, City, State, Zip Code) referred to herein Choir Director. For and in consideration of the mutual covenants contained in this Agreement, and other good and valuable consideration, the parties agree as follows: Church hereby offers and Choir Director hereby accepts the job of Choir Director of Church pursuant to the terms of this Agreement. I. Primary Function of Position: To rehearse the Sr. Choir for their active participation and leadership role in the scheduled Sunday worship services and other services as required by Church: Choir Director also agrees to the duties and responsibilities below: A.Select all choral anthems to be sung by the choir. Music should be appropriate for use in the liturgical service and, if possible, follow the theme or the lessons appointed for the day. Music selections shall be made in consultation with the Pastor whenever possible, and given to the organist well in advance of their rehearsal and performance by the choir. B. Choir anthems shall be sung under the direction of the Choir Director at worship services weekly, unless other choirs, soloists or other arrangements have been made. The Choir Director shall also, upon request, arrange for choir member(s) participation in other portions of the liturgy. C. Be responsible for the choir's appearance, sound and delivery. D. Choirs shall rehearse weekly and at additional times as identified by special needs, with rehearsals conducted by the Choir Director. Agreement with Church Choir DirectorPage 2 of 4 E.Performance and celebration with special choir selections or programs of music is encouraged from time to time for the promotion of choral worship and the general spiritual health of the congregation. Special programs are normally presented seasonally and on Church Music Sunday. Arrangements for special soloists, accompanists or instrumentalist will be made by the choir director. F. Work with the pastor and Worship Committee in programs for teaching the music of the liturgy and hymns to the congregation at large. G. Purchase music and music supplies for the choir program. All expenditures shall be under the budgetary control of the Worship Committee. H. Perform the duties of the position in a cordial and cooperative manner with the Pastor, the Congregation Members and the choir.I. Give advice and assistance whenever requested by the Pastor. J. Attend Worship Committee meetings to facilitate communication and planning. II. Choir Director and Choir further agree to the following: A. Expectations.1.Choir Director will carry out the above expectations to the best of his/her ability. 2. Time of Service: The Choir Director is hired by the Congregation Council and performs his/her duties from the weekend after Labor Day through the weekend before Memorial Day. 3. Substitute directors for rehearsal or performance and their compensation will be the responsibility of the Choir Director. B. Remuneration. 1. Church will also pay the Director $ per year minus required withholding payable over 12 months. 2.The congregation will support the Director with Christian love and prayers. The Congregation Council and the pastor will help with guidance and advice. If any problems arise with other staff members or congregation members they should be dealt with through the Pastor and the Congregation Council. Agreement with Church Choir DirectorPage 3 of 4 III. Compensation of Employment. Church shall pay Choir Director, and Choir Director shall accept from Church , in full payment for Choir Director's services under this Agreement, compensation at the rate of $ per year, payable twice a month on the (Number) and days of each month while this Agreement shall be in force. Church shall (Number) reimburse Choir Director for all necessary expenses incurred by Choir Director while traveling pursuant to Church's directions. IV. Term of Employment. The term of this Agreement shall be a period of (Number) years, commencing on and terminating on , subject, however, to (Number) (Number) prior termination as provided in this Agreement. At the expiration date of this (Number) prior agreement shall be considered renewed for regular periods of one year, provided neither party submits a notice of termination. V. Other Employment. Choir Director shall devote all of (his/her) time, attention, knowledge, and skills solely to the business and interest of Church , and Church shall be entitled to all of the benefits, profits, or other issues arising from or incident to all work, services, and advice of Choir Director. VI. Choir Director’s Inability to Contract for Church. In spite of anything contained in this Agreement to the contrary, Choir Director shall not have the right to make any contracts or commitments for or on behalf of Church without first obtaining the express written consent of Church . VII. Vacation. Choir Director shall be entitled to days of paid vacation each (Number) year during the term of this Agreement, the time for such vacation to be determined by mutual agreement between Church and Choir Director. VIII. Termination. A. This Agreement may be terminated by either party on days' written (Number) notice to the other. If Church shall so terminate this Agreement, Choir Director shall be entitled to compensation for days. (Number) B. In the event of any violation by Choir Director of any of the terms of this Agreement, Church may terminate employment without notice and with compensation to Choir Director only to the date of such termination. IX. Severability. The invalidity of any portion of this Agreement will not and shall not be deemed to affect the validity of any other provision. If any provision of this Agreement is held to Agreement with Church Choir DirectorPage 4 of 4 be invalid, the parties agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed by both parties subsequent to the expungement of the invalid provision. X. No Waiver. The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred. XI. Governing Law. This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of . (Name of State) XII. Notices. Unless provided herein to the contrary, any notice provided for or concerning this Agreement shall be in writing and shall be deemed sufficiently given when sent by certified or registered mail if sent to the respective address of each party as set forth at the beginning of this Agreement. XIII. Mandatory Arbitration. Notwithstanding the foregoing, and anything herein to the contrary, any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. XIV. Entire Agreement. This Agreement shall constitute the entire Agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement. XV. Modification of Agreement. Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party.
