Apprenticeship Agreement to Teach Cosmetology This Agreement is made on the day of , 20 , between _____________________ of __________________________________________ (street address, city, state) (hereafter referred to as Employer ) and _____________________ of __________________________________________ (street address, city, state), (hereafter referred to as Apprentice ). 1. Trade Description and Term of Apprenticeship Employer shall instruct apprentice in the trade, craft, or skill of Cosmetology. Apprentice, as consideration for such instruction, serve and render services in the capacity of an Apprentice of Employer from the ____day of __ , 20 , to the day of ___________________ , 20 . 2. Duties of Apprentice The duties and assignments of Apprentice shall include ______________________________________________________________________________ ______________________________________________________________________________ ______________________________________________________________________________ (specify duties of apprentice in light of particular craft, skill or trade), which duties and assignments shall change from time to time as Apprentice gains knowledge in the trade, craft or skill of Cosmetology. Apprentice shall be responsible for maintaining a record of the time spent by Apprentice on each work process and in related and supplemental instruction. Apprentice shall satisfactorily learn, and perform, work tasks and duties assigned to Apprentice on the job and in related instruction. 3. Hours of Instruction and Scale of Wages Employer shall instruct Apprentice for a total of ________ hours per week. Employer shall compensate Apprentice at the rate of ___________________________ Dollars (not less than minimum wage) per hour for the services rendered by Apprentice during the first ________ Months of this Apprenticeship, and __________________________ Dollars per hour for the second _________ Months of this apprenticeship. Apprentice shall be compensated for time spent in instruction. 4. Probationary Period The initial _______________ weeks of employment and instruction pursuant to this apprenticeship agreement shall be a probationary period for Apprentice. During such period, this agreement may be immediately terminated at the request in writing of either party. 5. Termination for Cause Either Employer or Apprentice may terminate this agreement on failure of the other party to satisfactorily perform obligations under the agreement. 6. Indemnification and Hold Harmless Agreement The Apprentice shall indemnify and hold harmless the Employer from and against any and all claims, liabilities or damages which arise from the actions of Apprentice while in the employ of Employer or as a result of the training by Employer of Apprentice pursuant to this agreement. This indemnification shall include the costs of litigation and counsel fees. 7. Mandatory Arbitration Notwithstanding the foregoing, and anything herein to the contrary notwithstanding, any dispute under this agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
