What an Au Pair Employment Contract Covers

An Au Pair Employment Contract is a written agreement between a host family and an au pair that documents the scope of childcare duties, weekly hours, living arrangements, stipend or pocket money, time-off, and the contract term. It clarifies expectations on supervision, transportation, emergency procedures, and background checks. When the au pair participates through a J-1 cultural exchange or similar visa program, the agreement should align with program sponsor rules and any immigration requirements. The contract also establishes termination and notice procedures and preserves a record for tax and compliance purposes.

Why a Written Contract Matters

A clear Au Pair Employment Contract reduces misunderstandings, documents obligations and compensation, supports tax and immigration compliance, and provides evidence of mutual consent. Using an auditable electronic record helps meet retention and enforceability standards under ESIGN (15 U.S.C. ch. 96) and applicable state law.

Why a Written Contract Matters

Who Typically Prepares and Signs This Agreement

Legal advisors, tax preparers, or sponsor coordinators may review the contract to confirm it meets immigration, payroll, and local requirements.

  • Host families — parents or legal guardians arranging childcare and housing for the au pair.
  • Au pairs — individuals accepting placement who must agree to duties, schedule, and house rules.
  • Program sponsors and agencies — organizations that place au pairs and verify compliance with visa or cultural-exchange rules.

Core Sections to Include in the Au Pair Employment Contract

A professional contract groups obligations and protections into concise, labeled sections so each party understands duties, compensation, and legal remedies.

Parties

Identify the host family (names and addresses) and the au pair (legal name, date of birth, passport number if relevant). Include sponsor contact where applicable.

Term & Schedule

Specify the contract start and end dates, weekly work hours, bedtimes, curfew, and scheduled days off or vacation accrual.

Duties & Childcare

List primary childcare tasks, limits on non-childcare duties, maximum single-shift hours, and supervision expectations for minors.

Compensation & Benefits

Set the stipend amount and payment frequency, meal arrangements, pocket money, and reimbursement policies for work-related expenses.

Housing & Meals

Describe private or shared bedroom, bathroom access, utilities, internet access, and any house rules that affect living conditions.

Termination & Notice

Define notice periods, cause grounds for immediate termination, sponsor reporting obligations, and procedures for early departure.

Step-by-Step: Completing the Au Pair Employment Contract

Representative Use Cases

Two practical scenarios show how a clear contract reduces friction and supports compliance.

Host Family Case

A two-parent household formalized working hours and stipend before arrival to avoid disputes

  • Agreement included emergency protocols and a 30-day termination clause
  • As a result, both parties had clear expectations and the sponsor’s placement proceeded without administrative delays.

Agency-Sponsored Case

A placement agency required a signed contract to document living arrangements and background checks

  • Sponsor fielded contract review and acceptance
  • The signed contract served as proof of compliance during a routine program audit and streamlined sponsor reporting.
