Bylaws of Unincorporated Association of Subdivision Residents Bylaws of ______________________ (Name of Association) Article I Name, Area and Purpose The residents of the Area, as defined in Article II-A of these Bylaws and located in __________ ____________________ (City and State), do organize and establish an Association to be known as _____________________________ (Name of Association) (referred to in these Bylaws as the Association) for the purpose of promoting and protecting the public and private interests and general welfare of its Members and the community. Article II Membership Any resident of the Area is entitled to Membership in the Association. All Members of the immediate family of a residence shall be regarded as Members of the Association and their status shall be the same as that of the head of the family. A. Residents in the Area who own their own home shall be known as full Members and, if in good standing, shall be entitled to: 1. Vote on all matters referred to them by the Board of Directors (one vote per house). 2. Hold office in the Association. 3. Elect representatives to the Board of Directors. 4. Share benefits of any actions taken by the Association for the welfare of the Members. B. Residents in the Area who do not own their home shall be known as Resident Members and, if in good standing, shall be entitled to all the privileges of a full member except that they shall not be eligible to hold an elected office in the Association. Article III Dues and Assessments A. The dues of all Members of the Association shall be fixed from time to time by the Board of Directors and payable yearly in advance for the fiscal year which begins _______________(month and day). Dues shall not exceed $_________ per year.
No member shall be required to pay dues in advance. B. The following assessments shall be established: 1. Annual dues of 50 per full member per year (maximum one 5,000); 2. Annual assessments of 100 per resident per year on the assessment of 50 per full member per year; 3. A special assessment for a person in a hospital or nursing home for the care of a disabled family member. No members of or any member's dependent children shall receive more than three (3) thousand dollars per year from assessments. C. All dues shall be paid to the association on a self-certified installment payment basis. The association shall charge an interest of three (3) per cent on installment payments by certified check, money order or bank draft. No charge shall be made on any payment made by any other means as set forth in rule an of these bylaws unless the payment is due to the association, except for penalties and interest charged on funds remaining in custody with a certified check, money order or bank draft. D. All assessments shall be payable in advance. All amounts to be paid at the expiration of the year shall be paid either in the following calendar year or by the first of the following calendar year, if any, following the due date or date of such payment; otherwise, such payments shall be prorated by the month and paid on the 1st and last day of each month. E. All dues and assessments shall be distributed monthly upon the dissolution of the association by a vote of the full membership with a quorum of two members. When a dissolution results in the loss or failure of all the shares held by the members, the remaining shares shall be distributed by the board of directors as follows: one half of the dividend shall be retained by each resident unless payment of the amount due is due to another association, in which event it shall be split among the remaining residents; and the remainder, the interest, shall be distributed among the resident owners in proportion to the percentage each owner owned at the time of the dissolution. 8 a resident that is the beneficiary or an officer of another association may receive a distribution in the same manner. Article iv board of directors there is established a board of directors of (name of association) for the purpose of maintaining the association, electing the board of directors and carrying out the provisions of these bylaws. The following shall be the qualifications for membership in the board of directors of the association: 1.
