Change & Forfeiture Rules — Important Notices

Elections under the Cafeteria Plan are binding for the plan year and may not be changed during the plan year except in the event of a qualifying status change consistent with the Plan Document (including but not limited to marriage, divorce, death, birth or adoption of a child, change in employment status of employee or spouse, or change in worksite). Any mid-year election change is subject to the terms, timeliness requirements and documentation requirements of the Plan Document and the Plan Administrator's determination.

Amounts contributed to the Health Care FSA and Dependent Care FSA are subject to plan provisions regarding forfeiture. Unreimbursed balances at plan year end may be forfeited unless specific carryover or grace period provisions apply under the Plan Document.

The Plan Administrator has the authority to interpret plan provisions, to make eligibility and election determinations, and to resolve disputes. The official Plan Document controls all rights and obligations; this election form is an administrative record of your choices.

Qualifying Event Declaration (if applicable)

If requesting a mid-year change, check the qualifying event(s) that apply and provide the date of event and required documentation to HR within the time limits stated in the Plan Document:

What the Cafeteria Plan Election Form Is

A Cafeteria Plan Election Form documents an employee’s choices under an employer-sponsored Section 125 plan, such as pre-tax contributions to health flexible spending accounts (FSA), dependent care FSA, and elective benefits. Employers use the form to capture the employee’s selected salary reduction amounts, plan effective dates, and any permitted mid-year change events. Properly completed elections determine pre-tax payroll withholding and benefits eligibility for the plan year and must align with the employer’s written plan document and IRS rules governing cafeteria plans.

Why Accurate Elections Matter for Employers and Employees

Correct elections ensure proper tax treatment, accurate payroll withholding, and benefits eligibility under the employer’s Section 125 plan.

Why Accurate Elections Matter for Employers and Employees

Who Completes and Processes the Cafeteria Plan Election Form

Coordination among these parties helps ensure elections are recorded, payroll is adjusted correctly, and plan compliance is maintained.

  • Employees choosing pre-tax benefits during open enrollment or qualifying life events.
  • HR or benefits administrators who verify eligibility and enter elections into payroll/benefits systems.
  • Payroll providers and third-party administrators who implement salary reductions and reconcile contributions.

Core Parts of a Professional Cafeteria Plan Election Form

A complete form groups employee data, specific elections, plan year rules, and authorization details so payroll and benefits systems can process elections reliably.

Key Milestones Across a Plan Year

Employees submit elections within the employer’s designated enrollment window.

03

Effective Date

Elections take effect on the stated plan year start date.

Common Preparation Mistakes to Avoid

  • Entering estimates instead of exact contribution amounts, which can cause payroll mismatches and require corrective adjustments.
  • Failing to attach required proof for qualifying events, leading to rejected mid-year election changes and delayed coverage.
  • Mismatching employee name or ID from HR records, resulting in misapplied withholdings or audit complications.
  • Missing employer deadlines or payroll cutoffs, which can defer elections until the next plan cycle and frustrate employees.

Consequences of Incorrect or Noncompliant Elections

Tax Reclassification: Benefits may be taxed retroactively
Plan Disqualification: Entire plan could lose tax-favored status
Payroll Adjustments: Requires corrective withholding and reconciliations
IRS Audit Exposure: Documentation gaps increase audit risk
Employee Liability: Employees may owe back taxes or penalties
COBRA Issues: Incorrect elections complicate continuation coverage

Security, Compliance, and Data Controls to Expect

Encryption: AES-256 at rest; TLS 1.2/1.3 in transit
Audit Trail: Signed document history with timestamps and IP data
HIPAA: BAA required when protected health information is present
Authentication: Email, SMS, or stronger multi-factor options available
Regulatory: ESIGN and UETA compliant for enforceability
Certifications: SOC 2 Type II, ISO 27001 listed where applicable

Practical Tips for Accurate and Efficient Elections

Adopt these practices to reduce rework, shorten processing times, and maintain compliance.

Standardize Field Formats
Require MM/DD/YYYY for dates and a single format for employee IDs to prevent data-mapping errors between HR and payroll systems.
Use Conditional Logic
Show supporting-document upload fields only when a qualifying life event is selected to reduce incomplete submissions and speed reviewer decisions.
Reconcile with Payroll
Perform a payroll reconciliation after each enrollment window to confirm salary reductions match submitted elections and correct discrepancies promptly.
Maintain Audit Records
Store signed copies and an immutable audit trail for the statutory retention period to support IRS or plan compliance reviews.
