Authorizations and Consents

I understand that as a condition of consideration for employment, the employer may obtain consumer reports and investigative consumer reports concerning my background from third-party vendors. These reports may include, but are not limited to, verification of my education, prior employment, professional licenses, motor vehicle driving records, criminal history, credit history where job-related, and other background checks as permitted by law.

I expressly authorize the employer, its agents and service providers to obtain such reports. I authorize any current or former employers, educational institutions, law enforcement agencies, courts, motor vehicle departments, and other persons or entities to provide to the employer any information they may have regarding me. I release and hold harmless all such persons and entities from liability for providing this information in good faith.

This authorization is valid for the duration of the hiring process and, if employed, during the period of my employment where such checks are job-related and consistent with applicable law. I understand I have the right to revoke this authorization at any time by providing written notice, but that such revocation will not apply to reports already requested or obtained prior to receipt of revocation.

Consent to specific checks (check any that you authorize):

I understand that certain positions may require additional background screening and that refusal to consent to screening required for the position may disqualify me from consideration for employment. I further understand that negative information discovered in a background check will be considered in light of its relevance to the position sought.

Unless otherwise agreed in a signed written agreement, if hired, my employment will be at-will, which means either I or the employer may terminate the employment relationship at any time, with or without cause or notice, consistent with applicable law.

Equal Employment Opportunity: The employer is an equal opportunity employer and does not discriminate on the basis of race, color, religion, sex, national origin, age, disability, genetic information, veteran status, or other protected characteristics as required by law.

Applicant Certification: I certify that all information I have provided on this form and any attachments is true, complete and correct to the best of my knowledge. I understand that any false, misleading, or omitted information may disqualify me from further consideration or, if discovered after hiring, may result in disciplinary action up to and including termination.

By signing below I authorize the release of information and waive any claims against the employer, its agents, or any person or entity providing information in good faith in response to requests in connection with my application or employment. I understand that I may be required to provide additional documentation or consents for specific checks where required by law.

What the Candidate Employment Consent Form Is and When It’s Used

A Candidate Employment Consent Form documents a job applicant's explicit permission for employer actions such as background checks, reference checks, verification of credentials, and collection of personal data required for hiring. The form typically explains the scope of consent, how information will be used, data retention, and signature authorization. It helps employers comply with federal and state rules on notice and consent, demonstrates candidate intent to allow specific checks, and creates an auditable record for recruiting, onboarding, and regulatory purposes.

Why Using a Clear Consent Form Matters

A well‑designed Candidate Employment Consent Form protects employers and candidates by documenting consent, reducing liability, and supporting compliance with ESIGN, UETA, FCRA, and data privacy obligations.

Why Using a Clear Consent Form Matters

Who Prepares and Who Signs This Form

Typical preparers and signers include HR teams, hiring managers, third‑party background vendors, and the candidate whose consent is requested.

  • HR and Talent Acquisition teams who need documented permission for screening and verification
  • Hiring managers and department leads who request role-specific checks or credential verification
  • Third‑party background screening providers who require candidate authorization before running searches

Use role-based copies and version control so each party retains the record elements they need for audit and retention purposes.

Step‑by‑Step: Completing and Issuing the Consent Form

Follow these four practical steps to prepare, obtain, and store candidate consent efficiently.

  • 01
Prepare the template: Draft scope, disclosures, and retention language; include FCRA and privacy disclosures if applicable.
  • 02
Add required fields: Place name, DOB, SSN, scope boxes, signature blocks, and authentication controls.
  • 03
Send to candidate: Deliver via secure eSignature or secure email with clear instructions and access options.
  • 04
Archive the record: Store executed copies per retention policy and preserve audit trails for compliance.

Essential Elements Your Consent Form Should Include

Common Preparation and Execution Errors to Avoid

  • Using vague scope language that does not clearly list specific checks, causing vendor delays and candidate disputes.
  • Collecting unnecessary sensitive data without documented business need or appropriate privacy safeguards ahead of processing.
  • Failing to include FCRA disclosures and consent when consumer reports are used, exposing the employer to statutory liability.
  • Relying on weak authentication or unsigned records, which undermines proof of consent and weakens audit defensibility.

Legal and Compliance Risks from Incorrect Consent Handling

I-9 Violations: $281–$2,789 per violation
FCRA Noncompliance: Civil liability and statutory damages
Privacy Breach: Potential state fines and remediation costs
Tax Withholding: Backup withholding 24% for missing TIN
Invalid Consent: May render checks unenforceable
Litigation Costs: Attorney fees and settlement exposure

Real‑World Examples of Consent Form Use

These short examples show how different organizations use consent forms for hiring and compliance.

Optica Ventures — COO

Optica used a standardized consent form for remote hires to streamline checks

  • Reduced manual follow up by centralizing verifications
  • The result was faster onboarding, fewer mismatches, and clearer audit trails for compliance.

Fertility Centers of Illinois — Founder

The clinic required explicit consent for health‑related checks and PHI sharing
