DESIGNATION OF SUCCESSOR OPERATOR(Under Operating Agreement) STATE: COUNTY: This Designation of Successor Operator (the “Designation”), is dated to be effective _____, (the “Effective Date”), between _____, referred to as “Successor Operator,” and the owners of interest in the Contract Area, referred to as “Owners.” Successor Operator and Owner are collectively referred to in this Designation as the “Parties.” The Parties are owners of interests in the Contract Area that is the subject of an Operating Agreement (the “Agreement”) dated _____. The Contract Area deemed subject to tha t Agreement is described as follows: [Description of Lands comprising the Contract Area] By to the terms of the Agreement, Successor Operator, named above, has been (appointed/elected) the Successor Operator of the Contract Area, pursuant to the terms of t he Agreement. For the consideration provided for in the Agreement, Successor Operator agrees to fulfill and assume the obligations of “Operator” as provided for in the Agreement, from and after the Effective Date stated above, and the Owners recognize that Successor Operator is grante d the rights and privileges of “Operator” as provided for in the Agreement, and acknowledges that t he Agreement, as to the Contract Area described above, is in full force and effect. This Designation is executed by each of the Parties as of the date of the acknowledgements of their signatures, but shall be deemed effective as of the Effective Date stated above.
