- 1 - Contract for Deed CONTRACT FOR DEED THIS DAY this agreement is entered into by and between _______________________, hereinafter referred to as "SELLER", whether one or more, and _______________________, hereinafter referred to as "PURCHASER", whether one or more, on the terms and conditions and for the purposes hereinafter set forth: 1. SALE OF PROPERTY For and in consideration of TEN DOLLARS ($10.00) and other good and valuable considerations the receipt and sufficiency of which is hereby acknowledged, Seller does hereby agree to convey, sell, assign, transfer and set over unto Purchaser, the following property situated in ___________________ County, State of Nebraska, said property being described as follows: (Type description or attach description as exhibit "A") Together with all rights of ownership associated with the property, including, but not limited to, all easements and rights benefiting the premises, whether or not such easements and rights are of record, and all tenements, hereditaments, improvements and appurtenances, including all lighting fixtures, plumbing fixtures, shades, venetian blinds, curtain rods, storm windows, storm doors, screens, awnings, if any, and ____________________________________________now on the premises. SUBJECT TO all recorded easements, rights-of-way, conditions, encumbrances and limitations and to all applicable building and use restrictions, zoning laws and ordinances, if any, affecting the property.
It is further agreed that all improvements upon said premises, now in existence, and which before sale thereon, do at the time of the conveyance exist, are in full force, effect and suitably secured and are free and clear from any encumbrances. 2. All and any improvements previously constructed on said premises shall be the property of purchaser. 3. All and any improvements hereafter erected or constructed on said premises shall be deemed and are hereby included in the provisions of paragraph 1 hereinabove. 4. A purchase money order for the full purchase price of five dollars (5) dollars shall be presented to seller on delivery of the first lot to purchaser and, subject to the approval of the seller. 5. Upon the presentation of a cashier's check (1) equal in amount to five dollars (5) dollars upon payment of the full purchase price of said second lot (the “second purchase money order") and prior payment of any further sums due to seller, purchaser shall take title to and have full and complete title to said property and to all improvement. 6. The purchase price for the property shall be set off by the seller in full against any deficiency between the amount due on the sale of the second lot and the amount as set off. 7. The purchaser shall be entitled to sell at the same time and under the same conditions as if title had not been first conveyed. 8. Buyer's duties are as follows: to pay within ten (10) days after the date of the sale an additional sum of five dollars (5) dollars (the “buyee's fee") to the seller or to the consignor, whichever shall be the holder of the title. To execute the agreement of sale. If buyer fail to do so within ten (10) days after the first day of sale, he is deemed to have resigned. Seller agrees to pay buyer's fees and expenses as if the seller had sold the property subject to this contract. If buyer execute the agreement prior to the closing and is successful in doing so, the purchaser agrees to pay buyer's fees and expenses as if he had bought the property in spite of the foregoing. 9. If buyer fail to pay the seller the full purchase price within ten (10) days after the date of the sale, buyer becomes liable for all amounts due to seller except the deposit provided in paragraph 6 of purchase money order.
