What the Driving School Employment Contract Covers

A Driving School Employment Contract is a written agreement between a driving school and an individual who will provide instruction or administrative services. It sets out role and scope of work, compensation, schedule and hours, use of training vehicles, safety and licensing requirements, background checks, insurance and liability allocation, confidentiality and student data protections, training and certification expectations, and termination rights. The contract also clarifies whether the instructor is an employee or independent contractor and incorporates applicable regulatory obligations such as state DMV rules and federal e-signature standards (ESIGN and UETA) when executed electronically.

Why a Clear Employment Contract Matters for Driving Schools

A precise contract reduces disputes, ensures compliance with licensing and insurance rules, protects student safety, and documents compensation and liability. Clear terms also support consistent enforcement of policies and provide a record for audits or regulatory reviews.
