BEHAVIOR SUPPORT, INTERVENTIONS & RESTRAINT

The Educational Provider will implement positive behavior supports and least-restrictive interventions in accordance with the student’s individualized plan. Physical restraint or seclusion will not be used except as an emergency intervention to prevent imminent serious physical harm and only consistent with the provider’s written emergency response procedures. Parent/Guardian consent is required for development and implementation of behavior support plans.

Consent to release records is limited to educational, medical, and therapeutic information reasonably necessary to provide services and to comply with applicable recordkeeping and reporting obligations.

TRAINING, PARENT PARTICIPATION & MEETINGS

The Educational Provider will offer parent training and collaborative meetings as specified in the individualized plan. Parent/Guardian agrees to reasonable participation in planning meetings, training sessions, and home carryover consistent with the student’s goals.

FEES, PAYMENT & CANCELLATION

Cancellation and missed-session policy: Parent/Guardian must provide days notice for cancellations to avoid charges. Late payment may incur fees described in the payment plan.

TERMINATION, MODIFICATION & NOTICE

Either party may terminate or request modification of this Agreement by providing written notice. Provider will not terminate services without days notice except where immediate action is required for safety or for material breach of this Agreement.

LIABILITY, INDEMNITY & DISPUTE RESOLUTION

To the extent permitted by law, the Educational Provider and Parent/Guardian agree to act reasonably and to indemnify and hold harmless the other party from claims arising from negligent acts or omissions. Disputes arising from this Agreement shall first be addressed through good faith internal dispute resolution. If unresolved, the parties agree to participate in non-binding mediation prior to initiating formal legal proceedings. This Agreement shall be governed by applicable law.
