EDUCATION CODE OF CONDUCT

Purpose: This Education Code of Conduct establishes the standards of behavior, responsibilities, and disciplinary procedures applicable to all enrolled students. The Code applies to conduct on campus, at school-sponsored activities, during travel to and from such activities, and conduct off-campus that materially and substantially disrupts the educational environment or threatens the safety of the school community.

Student Information

Date of Birth:

Parent / Guardian Information (if student is a minor)

Emergency / Medical Information

Standards of Conduct

Expected Conduct: Students are required to act with integrity, respect, and consideration for the rights and safety of others. Students must comply with reasonable direction from school officials, comply with class attendance requirements, and maintain conduct that supports an effective learning environment.

Prohibited Conduct includes, but is not limited to: violence, threats, harassment, bullying, discrimination, retaliation, sexual misconduct, possession or distribution of illegal substances, possession of weapons, vandalism, theft, academic dishonesty (including cheating and plagiarism), falsification of records, unauthorized access to school information systems, and conduct that materially disrupts school operations.

Electronic Devices, Social Media, and Privacy

Electronic Use: Use of school networks, devices, and personal devices on school premises must comply with the Acceptable Use Policy. Unauthorized recording, distribution of images or video that violates privacy or safety, hacking, or circumventing security protections is prohibited and may result in disciplinary action.

Searches: Students have a limited expectation of privacy in school-controlled spaces and in school-issued devices. School officials may search lockers, bags, and electronic devices where there is reasonable suspicion of a violation of this Code, consistent with applicable law and school procedures.

Disciplinary Process and Remedies

Process: Reported violations will be investigated promptly. Students will be provided notice of allegations and an opportunity to respond. Sanctions may include restorative measures, warnings, detention, suspension, expulsion, or other remedies as appropriate to the severity of the violation. Sanctions will be applied in a manner that is fair, non-discriminatory, and consistent with the school's disciplinary framework.

Interim Measures: When necessary to protect the safety of the school community, the school may impose interim measures, including temporary suspension or change of placement, pending completion of an investigation.

Reporting, Investigation, and Appeals

Reporting: Students, staff, and third parties are encouraged to report suspected violations to designated school officials. Reports may be made in writing or verbally. The school will protect confidentiality to the extent reasonably possible while conducting a thorough investigation.

Appeals: A student or parent/guardian may appeal disciplinary findings or sanctions in writing within ten (10) school days of notice of decision. Appeals will be reviewed by an impartial administrator or panel according to the school's appeal procedures.

What the Education Code of Conduct Is and Why It Matters

An Education Code of Conduct is a formal policy that sets behavioral standards, academic integrity expectations, and disciplinary procedures for students, faculty, and staff at an educational institution. It typically defines prohibited conduct, reporting processes, investigation steps, sanctions, and appeal rights. The Code supports consistent decision-making, documents institutional obligations, and helps institutions align policies with federal frameworks such as FERPA and Title IX while clarifying roles and recordkeeping responsibilities.

Key Reasons to Adopt a Clear Code of Conduct

A written Code reduces disputes, clarifies responsibilities, and enables consistent disciplinary outcomes while supporting compliance with federal obligations such as FERPA and Title IX.

Key Reasons to Adopt a Clear Code of Conduct

Who Prepares and Uses This Document

Primary users include school administrators, compliance officers, faculty governance bodies, and student affairs staff responsible for policy creation and enforcement.

  • K–12 administrators managing student discipline, attendance, and parent communications.
  • Higher education officials drafting academic integrity rules and adjudication procedures for students.
  • Human resources and legal counsel advising on staff conduct, employment discipline, and faculty tenure processes.

Signed acknowledgements are retained in student or personnel records and used as evidence in investigations and appeals.

Step-by-Step: Preparing and Collecting Acknowledgements

Follow these sequential steps to prepare, distribute, collect, and file signed acknowledgements for the Education Code of Conduct.

  • 01
Prepare: Finalize scope, definitions, sanctions, and appeal procedures.
  • 02
Distribute: Notify affected parties and provide access to the full policy.
  • 03
Collect: Obtain dated signatures or electronic acknowledgements from required participants.
  • 04
File: Store signed records securely and log retention metadata.

Essential Elements of a Professional Education Code of Conduct

A complete Code sets clear scope, identifies prohibited conduct, outlines investigative and disciplinary procedures, specifies appeals, and describes recordkeeping and reporting responsibilities.

Scope

Clearly define who is covered (students, staff, contractors), where the Code applies (on-campus, online, off-campus programs), and jurisdictional limits for enforcement.

Prohibited Conduct

List academic dishonesty, harassment, discrimination, safety violations, and technology misuse with concrete examples and standards of proof for investigations.

Investigation Process

Describe reporting channels, initial assessment, timeline expectations, parties' rights, evidence handling, and optional advisor or counsel participation.

Disciplinary Range

Provide progressive sanctions—warnings, probation, suspension, expulsion, termination—plus criteria used to select appropriate remedies.

Appeals

Specify grounds for appeal, submission windows, decision authority, and records required to support an appeal or stay of sanction.

Recordkeeping

State retention responsibilities, access limitations, confidentiality practices, and procedures for preserving records needed for appeals or external review.

Security and Privacy Considerations for Conduct Records

FERPA Protections: FERPA protections apply to education records.
Encryption: TLS 1.2/1.3 in transit, AES-256 at rest.
Access Controls: Role-based access and least privilege.
Audit Trail: Time-stamped signature logs retained.
HIPAA Considerations: BAA required if records contain PHI.
Data Residency: Follow state and institutional storage policies.

How Electronic Acknowledgement Works in Practice

A typical e-sign workflow reduces friction and preserves a tamper-evident audit trail from distribution through final storage.

  • Upload: Upload the Code as a PDF or DOCX to the signing platform.
  • Place Fields: Add signature, date, and acknowledgement checkbox fields to the document.
  • Authenticate: Verify signers via email, SMS, SSO, or stronger methods when required.
  • Store: Save signed copies and exportable audit logs for retention.

Platform Capabilities to Look For

Ensure the eSignature platform supports FERPA-safe handling, tamper-evident audit trails, and configurable signer authentication options for institutional compliance.

  • Formats Supported: PDF, DOCX, and HTML formats accepted.
  • Integrations: Integrates with Google Workspace and Microsoft 365.
  • Security Standards: AES-256 at rest and TLS 1.2/1.3.

Online Workflow Settings for Distribution and Tracking

Configure workflows to authenticate signers, enable bulk distribution, capture audit logs, and export signed records for institutional archives.

Field Configuration
Signer Authentication Email link by default; SMS or SSO for higher assurance.
Bulk Distribution Enable bulk send for mass student or staff lists.
Audit Capture Record IP, timestamp, and signer actions.
Export Settings Set PDF export and secure storage destination.

Potential Penalties and Risks from Inadequate Processes

Disciplinary Sanctions: Probation, suspension, termination.
FERPA Risk: Improper disclosure may trigger complaints.
Title IX Exposure: Investigation or OCR review for mishandled complaints.
Civil Liability: Lawsuits or injunctions possible.
Operational Burden: Lengthy investigations disrupt operations.
Record Gaps: Missing evidence harms appeals and defense.

Common Mistakes to Avoid When Preparing the Code

  • Failing to obtain timely acknowledgements from all required parties, leaving gaps in evidence for later investigations or appeals.
  • Using vague or undefined terms for prohibited conduct, which creates inconsistent enforcement and complicates decision writing.
  • Applying policies inconsistently across similar cases, increasing legal exposure and allegations of bias or unfair treatment.
  • Storing signed records insecurely or without retention metadata, risking FERPA violations or inability to produce records.

Key Timing Expectations for Distribution and Processing

Set clear distribution and response deadlines to ensure coverage before academic terms, activities, or employment start dates and to support timely investigations.

Annual Distribution Deadline:

Issue the Code annually before each academic term begins.

Onboarding and Enrollment:

Collect signed acknowledgement during new-hire onboarding or student registration.

Activity or Trip Deadline:

Require signatures before participation in trips, internships, or labs.

Investigation Start:

Begin investigations promptly after a report is received.

Appeals Deadline:

State the timeframe for submitting appeals following sanction notice.
