This Contract governs extended hours care provided by Provider to the Student for the term beginning and continuing through unless earlier terminated in accordance with Section Termination and Withdrawal below.

Additional or irregular days of attendance must be communicated in writing to Provider at least days in advance and are subject to availability and additional fees.

Fees, Billing, and Payment

Late Payment Penalty: Provider shall assess a late fee of for payments not received within days after the due date. Continued nonpayment may result in suspension of services.

Termination and Withdrawal

Either party may terminate this Contract by providing written notice to the other party at least days prior to the effective date of termination. Provider may terminate immediately for material breach, nonpayment, or behavior that endangers others.

Health, Emergency, and Medications

Authorization for Emergency Medical Treatment: The undersigned authorizes Provider to seek emergency medical care and to arrange transportation for the Student when, in Provider's reasonable judgment, such action is necessary. The undersigned agrees to be financially responsible for all emergency medical costs incurred.

Responsibilities of Provider and Parent/Guardian

Provider Responsibilities include supervision, reasonable programming appropriate to age, response to incidents, and prompt notification of emergencies. Provider shall maintain staff-to-student ratios consistent with its policies and applicable licensing standards.

Parent/Guardian Responsibilities include timely payment, providing up-to-date emergency and medical information, ensuring timely pick-up, and informing Provider of changes in enrollment. The Parent/Guardian shall ensure the Student adheres to Provider policies.

Behavior, Discipline, and Suspension

Provider maintains a conduct policy. Repeated disruptive or dangerous behavior may result in progressive discipline up to temporary suspension or permanent dismissal from the program. Provider will document behavior incidents and attempt reasonable interventions prior to dismissal except where immediate removal is necessary for safety.

Confidentiality and Records

Provider will maintain records related to attendance, incidents, health, and billing. Records are confidential and will only be disclosed to authorized individuals or as required by law. Parents/Guardians may request access to the Student's records in accordance with Provider's policies.

Liability, Indemnification, and Insurance

Provider will carry general liability insurance customary for extended hours programs. Parent/Guardian releases Provider from liability for ordinary negligence to the fullest extent permitted by law and agrees to indemnify and hold Provider harmless from claims, demands, or causes of action arising from Parent/Guardian's willful misconduct or gross negligence. This clause does not affect non-waivable statutory rights.

Amendments; Governing Law

Any amendment to this Contract must be in writing and signed by both parties. This Contract is governed by the laws of the state in which Provider operates; venue for disputes shall be the courts of that state.
