Release, Assumption of Risk, and Indemnification

In consideration of participation in the program or activity described above, the undersigned acknowledges and agrees as follows:

1. Assumption of Risk: The undersigned understands that participation in educational activities, field trips, athletics, transportation to or from events, and related activities involves inherent risks including but not limited to bodily injury, illness, permanent disability, and death, and that such risks may arise from the participant's own actions, the actions or negligence of others, or the condition of facilities or equipment. The undersigned voluntarily assumes all such risks.

2. Release and Waiver: To the fullest extent permitted by law, the undersigned releases, waives, discharges and covenants not to sue the school district, school, program sponsor, their boards, officers, employees, agents, volunteers and representatives (collectively, the Released Parties) from liability for any and all claims, demands, causes of action, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or related to the participant's participation in the program, whether caused by the negligence of the Released Parties or otherwise.

3. Indemnification: The undersigned agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, suits, damages, liabilities or expenses, including attorneys' fees, arising from or related to the participant's actions or omissions while participating in the program.

4. Emergency Medical Authorization: If the participant requires emergency medical treatment and the undersigned cannot be reached, the undersigned authorizes the Released Parties to secure emergency medical care and transportation as deemed necessary. The undersigned is responsible for all costs associated with such care.

5. Acknowledgment of Rules: The undersigned agrees that the participant will comply with all applicable rules, policies, and reasonable directions of program staff. Failure to follow rules may result in removal from the activity without refund.

6. Severability and Governing Law: If any provision of this Waiver is found unenforceable, the remaining provisions shall remain in full force and effect. This Waiver shall be governed by and construed in accordance with the laws of the state in which the program is conducted.
