EDUCATION LIFESTYLE PROGRAM AGREEMENT

Refund Policy: Participant is entitled to refunds only as expressly stated below. Provider will issue refund in accordance with the schedule published in this Agreement. Cancellation by Participant more than 14 days prior to start: full refund less administrative fee. Cancellation within 14 days or after start: no refund except at Provider's sole discretion. Any dispute over refund entitlements shall be resolved under the Dispute Resolution clause below.

Participant Responsibilities & Conduct

Attendance and active participation are required. Participant agrees to comply with program policies, schedules and reasonable directions from Provider staff. Provider may suspend or terminate participation for failure to comply, disruptive behavior, or any conduct that jeopardizes safety or program integrity.

Health, Medical and Emergency Authorization

Medical Conditions, Allergies, Medications: Participant (or Parent/Guardian) must disclose conditions requiring accommodation, listed below. Provider is authorized to obtain emergency medical treatment if Parent/Guardian cannot be reached and will make reasonable efforts to contact emergency contacts.

Intellectual Property, Confidentiality, Media

Provider retains ownership of program curricula, materials, methodologies and any copyrighted works provided. Participant may not reproduce or distribute materials without prior written consent. Participant consents to the collection and use of photographs or video that may include Participant for promotional or educational purposes, except where the Participant (or Parent/Guardian) has expressly declined below.

Liability, Indemnity and Insurance

Participant acknowledges risks associated with program activities. To the fullest extent permitted by law, Participant (or Parent/Guardian) releases and agrees to indemnify Provider from claims, liabilities, damages or expenses arising out of Participant's participation, except where caused by Provider's gross negligence or willful misconduct. Participant is encouraged to maintain personal health and accident insurance.

Termination, Withdrawal and Remedies

Provider may terminate this Agreement for material breach, nonpayment, or safety concerns. Participant may withdraw in writing; refunds shall be governed by the Refund Policy above. Provider's remedies for breach include suspension, termination, and recovery of unpaid fees and reasonable costs.

Dispute Resolution and Governing Law

This Agreement is governed by the substantive laws of the state in which Provider operates. Parties will attempt to resolve disputes in good faith prior to initiating legal proceedings. If litigation is necessary, the prevailing party is entitled to recover reasonable attorneys' fees and costs as allowed by law.
