Cancellation, Withdrawal and Refunds

The Provider's cancellation and refund policy is binding. If the Student withdraws prior to the program start date, any applicable refund will be issued according to the schedule below and less non-refundable deposit and any unrecoverable administrative costs. Refunds after commencement are prorated on a weekly basis only where the Provider has notice of withdrawal and space is later filled. Early termination by the Provider for cause does not entitle the Student to refunds except as required by law.

Make-up Lessons, Absences and Tardiness

Make-up lessons are provided at the Provider's discretion and subject to availability. Provider requires advance notice for cancellations. Unexcused absences and habitual tardiness may forfeit lessons without refund. The Provider may limit make-up lessons per term.

Health, Emergency and Medical Information

Media, Recording and Intellectual Property

The Provider may record lessons for instructional or administrative purposes. The Provider shall obtain express consent prior to public distribution of recordings. Student original compositions and performances created in the course of instruction are subject to the ownership and licensing terms set forth below.

Liability, Indemnity and Insurance

The Student and Parent/Guardian (if Student is a minor) release and hold harmless the Provider, its instructors, agents and employees from claims arising out of participation in lessons, except where caused by the Provider's gross negligence or willful misconduct. The Student/Parent shall indemnify the Provider for claims arising from Student conduct. The Provider recommends that the Student maintain personal health insurance.

By checking the box below and signing this Contract, the undersigned acknowledges that they have read and accept the liability and indemnity provisions.

Termination and Default

Either party may terminate this Agreement for material breach if the breach remains uncured after written notice and a reasonable cure period. The Provider may suspend instruction for nonpayment. Termination does not relieve the Student of outstanding payment obligations incurred prior to termination.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of the state in which the Provider maintains its principal place of business. The parties agree to attempt to resolve disputes in good faith before pursuing formal legal proceedings. If litigation is necessary, the prevailing party is entitled to recover reasonable attorneys' fees and costs.
