EDUCATION NURSE CONTRACT

This Education Nurse Contract (Contract) is entered into as of Effective Date: by and between School/Institution: (hereinafter "School") and Registered Nurse: (hereinafter "Nurse").

RECITALS

WHEREAS, the School requires professional nursing services to support student health needs and comply with applicable health laws and regulations; and WHEREAS, the Nurse is duly licensed and qualified to provide such services in educational settings; the parties agree to the terms set forth below.

1. SCOPE OF SERVICES

The Nurse shall provide professional nursing services including, but not limited to, assessment and triage of student health concerns, administration of medications per written orders, development and implementation of individual health care plans, emergency care, staff training related to student health needs, documentation of care, and communication with parents/guardians and health care providers as appropriate. Specific duties and limitations are set forth below and may be amended by mutual written agreement.

2. TERM

This Contract shall commence on Start Date: and shall continue until End Date: unless earlier terminated pursuant to Section 9.

3. COMPENSATION AND INVOICING

The Nurse shall submit invoices at least monthly and invoices shall include dates of service, hours worked, and a brief description of services performed. Payments shall be made within days of receipt of a properly documented invoice. Reimbursement for pre-approved travel or supplies will be made when documented on the invoice.

4. STATUS, BACKGROUND CHECKS, AND CREDENTIALS

The Nurse acknowledges and agrees that the relationship under this Contract is Independent Contractor Employee (select one). The Nurse shall obtain and maintain all licenses, clearances, background checks, fingerprinting, and health screenings required by law or School policy prior to providing services.

I certify that required criminal background check and fingerprinting (if required) have been completed and are clear.

5. PROFESSIONAL LIABILITY INSURANCE

The Nurse shall maintain professional liability insurance and provide certificate(s) of insurance upon request. The School shall be named as an additional insured for activities performed on School premises to the extent required by law and acceptable to the Nurse's insurer.

6. CONFIDENTIALITY AND RECORDS

The Nurse shall maintain confidentiality of student health information and comply with all applicable privacy laws governing education and health records. Medical records prepared by the Nurse in the course of providing services are School records and shall be retained, transmitted, and released only in accordance with School policy and applicable law.

The Nurse shall immediately report to the School any suspected abuse or neglect of a child in accordance with mandatory reporting laws.

The Nurse shall cooperate with School administration, follow written health policies, and provide periodic written reports of activities as requested by the School.

9. TERMINATION

Either party may terminate this Contract without cause upon days' written notice. The School may terminate immediately for cause, including but not limited to failure to maintain required credentials, breach of confidentiality, or conduct endangering students.

10. INDEMNITY

The Nurse shall indemnify and hold harmless the School, its officers, employees, and agents from and against claims, liabilities, losses, and expenses arising out of the Nurse's negligent acts, omissions, or willful misconduct in performance of the services, except to the extent caused by the School's gross negligence or willful misconduct.

11. COMPLIANCE WITH LAWS

The Nurse shall perform services in compliance with all applicable federal, state, and local laws, regulations, and professional standards. The Nurse shall immediately notify the School of any action, investigation, or complaint relating to the Nurse's professional conduct or licensure status.

This Contract constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior agreements. Amendments must be in writing and signed by authorized representatives of both parties. If any provision is held invalid, the remaining provisions shall remain in full force and effect.

By signing below, the Nurse certifies that all information provided in connection with credentialing is true and accurate, that the Nurse holds an active unrestricted license to practice, and that the Nurse will notify the School promptly of any change in licensure, insurance, criminal history, or professional standing.

The School certifies that it will provide safe working conditions, necessary access to student records as permitted by law, and will comply with applicable policies to support the provision of student health services.
