Refund Policy — Terms and Calculation

This Education Refund Agreement sets forth the exclusive refund obligations of the Institution to the Student (or Parent/Guardian where applicable). Refunds will be calculated according to the schedule and procedures below. The parties agree that institution records of enrollment and payment shall be presumptive evidence of the date of withdrawal for purposes of refund calculation.

Withdrawal Date (date Student initiated or Institution recorded):

Refund Schedule (by reference to days of program or term): Unless otherwise stated in a separate written agreement, refunds will be computed as follows: (a) prior to the first day of scheduled instruction — full tuition less non‑refundable deposit and any assessed administrative fee; (b) within the first 10% of the scheduled instruction period — 75% of tuition payable after deductions; (c) after 10% but within 25% — 50% of tuition payable after deductions; (d) after 25% but within 50% — 25% of tuition payable after deductions; (e) after 50% — no tuition refund except where otherwise required by law. The parties acknowledge that fees for materials and special services may be excluded from refunds when such items are expended or non‑returnable.

Third‑Party Payments, Loans and Set‑offs

If tuition or fees were paid by a third‑party payer, scholarship, sponsor, or loan program, the Institution may return refunded amounts to such payer as required by the payer's terms. The Institution shall notify the Student of any third‑party repayment obligations. The Institution reserves the right to set off outstanding charges, tuition balances, or other lawful debts of the Student against any refund due.

Scholarship or External Aid Applied:    Loan Amount Applied:

Timing, Method and Receipt of Refund

Refunds due will be processed within thirty (30) calendar days of the Institution's determination of withdrawal or termination unless a different period is required by law or a separate agreement. Refunds will be issued by check, electronic transfer, or other method at the Institution's discretion, and will be made payable to the Student or to the third‑party payer when applicable. If the Student requests a specific refund method, such request is subject to Institution operational procedures and identification verification.

Dismissal, Misconduct, and Forfeiture

If withdrawal is the result of disciplinary dismissal for cause, academic dishonesty, or other misconduct, the Student may forfeit any refund in whole or in part as determined under Institutional policy. Any such forfeiture shall be set forth in writing and delivered to the Student with an explanation of the calculation.

What an Education Refund Agreement Covers

An Education Refund Agreement is a written contract that defines when and how an educational provider returns tuition, fees, or deposits to a student or payer. It typically spells out eligible refund events, calculation methods, prorated schedules, obligations to return institutional materials, and any administrative or processing deductions. The agreement also identifies the parties, effective date, and the choice of governing law. Institutions use it to set clear expectations and to document the financial and procedural basis for refunds to reduce disputes and support consistent processing.

Why a Clear Refund Agreement Matters

A concise Education Refund Agreement reduces ambiguity about eligibility, timing, and calculations, which lowers dispute risk and improves financial forecasting for both the institution and the payer.

Why a Clear Refund Agreement Matters

Who prepares and relies on an Education Refund Agreement

Use the agreement as both an operational guide for staff and a disclosure to payers at registration or enrollment to create a documented refund record.

  • Students and families who pay tuition, deposits, or program fees and need a clear refund mechanism.
  • Administration staff in registrars, bursars, or finance offices responsible for processing refunds and applying policy consistently.
  • Third-party training providers and workforce development organizations that accept payments and manage withdrawals or cancellations.

Core elements to include in a professional Education Refund Agreement

A professional agreement organizes the refund process into clear sections so signers understand eligibility, method of calculation, timelines, and administrative procedures.

Parties

Identify the institution and the payer with full legal names and contact details to make the agreement enforceable and attributable.

Effective Date

State the agreement start date and whether refunds apply retroactively to prior payments or only to future enrollments.

Eligibility

Define circumstances that trigger refunds such as withdrawal, program cancellation, failure to meet entry requirements, or institutional closure.

Calculation

Describe prorated schedules, flat-fee deductions, administrative charges, and whether refunds exclude nonrefundable fees.

Process

Detail the steps to request a refund, required documentation, review procedures, and expected timeline for processing.

Governing Law

Specify the state law that will interpret the agreement and any arbitration or dispute-resolution provisions.

Step-by-step: completing and submitting the agreement

Use this sequence to prepare, sign, and process an Education Refund Agreement so parties remain aligned and records are complete.

  • 01
Prepare Document: Populate party details, program, payment dates, and refund calculation method.
  • 02
Attach Proof: Include receipts, withdrawal notices, or administrative cancellation records.
  • 03
Signatures: Obtain required signatures from the payer and an authorized institutional representative.
  • 04
Submit for Processing: Send to the bursar or finance office and retain a signed copy in the student record.

Configure an online refund workflow

Set up routing, authentication, and approvals to automate review and limit manual handoffs.

Where to send the completed agreement and supporting documents

Return the signed agreement to the office responsible for refunds and include any required receipts to speed processing.

  • Registrar/Bursar: Primary repository for signed agreements and refund authorization.
  • Finance/Accounts: Processes payments and issues refunds according to the approved method.
  • Student Record: Attach a PDF of the signed agreement to the student file for audit and retention.
  • Third-Party Agent: If a vendor handled payment, send a copy to their accounts payable for reconciliation.

Digital signing and eSubmission considerations

Ensure the chosen platform complies with applicable privacy and recordkeeping requirements before accepting electronic signatures and storing records.

  • Authentication: Choose email link or SMS code; use stronger KBA or multi-factor if identity proofing is required.
  • File Formats: Accept signed PDFs and retain an uneditable final copy with an audit trail.
  • Integrations: Connect to your student information system for automatic attachment to the student account.

Common preparation mistakes to avoid

  • Not specifying the refund method or failing to capture accurate bank/card details for payout.

Consequences of incorrect or incomplete agreements

Delayed Refunds: Incomplete forms cause processing delays and reputational issues.
Financial Loss: Incorrect calculations can create overpayments or underpayments affecting budgets.
Regulatory Risk: Noncompliance with state refund laws risks penalties or mandated restitution.
Disputes: Ambiguous terms increase the likelihood of appeals or collection of legal fees.
Tax Reporting Issues: Incorrect payer identification can trigger backup withholding or IRS mismatches.
Data Privacy: Improper handling of personal data may violate institutional privacy obligations.
