This Education Remediation Contract is made effective as of between the educational institution and the student or the student's parent/guardian, under the terms set forth below.

Attendance Requirement: Student will attend scheduled sessions and notify Institution at least 24 hours in advance of cancellations except in emergencies.

Active Participation: Student will complete assigned work, assessments, and practice between sessions as directed by instructors.

Academic Integrity: Student will abide by the Institution's academic integrity standards during remediation and assessments.

Confidentiality and Records

Student records, assessment results, and progress reports are educational records. The Institution shall maintain confidentiality in accordance with applicable education privacy standards and shall disclose records only as authorized by law or with written consent.

Termination; Suspension; Remedies

Either party may terminate this Contract for cause upon written notice if the other party materially breaches any obligation and fails to cure within ten (10) business days of receipt of notice. The Institution may suspend services immediately for nonpayment or for behavior that endangers staff or other students.

Liability, Indemnification & Insurance

The Institution shall maintain appropriate professional liability insurance. To the fullest extent permitted by law, the Student and Parent/Guardian agree to indemnify and hold harmless the Institution, its employees and contractors from third-party claims arising from Student actions outside the scope of instruction. The Institution's liability for breach is limited to direct damages not to exceed the total fees paid under this Contract.

Dispute Resolution and Governing Law

The parties agree to attempt good faith negotiation to resolve disputes. If unresolved, disputes will be resolved by binding arbitration before a neutral arbitrator in the jurisdiction specified below. This Contract is governed by the laws of the state indicated in the jurisdiction clause stated here.

Acknowledgment and Certification
