This Education Transfer Contract (the Agreement) is entered into by and between the Student/Parent or Legal Guardian identified below and the Receiving Institution identified below for the transfer of the Student's enrollment, academic records, and related obligations effective as set forth herein.

Financial Obligations and Tuition

Outstanding balances, tuition refunds, or prorated charges associated with the Student's enrollment at the Sending Institution shall be addressed as follows. The Student/Guardian acknowledges that outstanding balances may delay release of certain records until arrangements are made.

Academic Evaluation and Acceptance of Credits

The Receiving Institution shall evaluate the credits and courses submitted for transfer and shall issue a determination of accepted credits in writing to the Student and Sending Institution within days of receipt of requested records.

Consent and Release of Records

By signing this Agreement, the Student or Parent/Legal Guardian authorizes the Sending Institution to release and disclose the Student's education records and related information identified above to the Receiving Institution for purposes of enrollment evaluation, placement, and maintenance of academic and financial records. This authorization includes copies of transcripts, disciplinary determinations, health and immunization records (if checked above), and special education documents where applicable.

I authorize release of the Student's records as described above and acknowledge that this consent may be revoked in writing except to the extent that action has already been taken in reliance on it.

Representations, Warranties and Indemnity

The Student/Guardian represents and warrants that the information supplied in this Agreement is true and accurate to the best of their knowledge and that they have the legal authority to execute this Agreement. The Receiving Institution represents that it will evaluate and process transferred records in accordance with its published academic policies. Each party agrees to indemnify and hold harmless the other party from claims arising from their respective breaches of this Agreement or misrepresentations made herein.

Dispute Resolution and Governing Law

Any dispute arising under this Agreement shall first be referred to the respective administrative offices of the Sending and Receiving Institutions for informal resolution. If informal resolution fails, the dispute shall be governed by the laws of the state specified below and resolved by the exclusive jurisdiction of the courts located in that state unless the parties agree to mediation in writing.

Miscellaneous Provisions

This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior discussions and agreements. Any modification or waiver of any provision of this Agreement must be in writing and signed by an authorized representative of each party.

Acknowledgment

The undersigned certify that they have read and understand the terms of this Education Transfer Contract and have the authority to execute this Agreement on behalf of the party they represent. Execution of this Agreement authorizes the Sending Institution to transmit records as specified and authorizes the Receiving Institution to evaluate and apply transferred credits in accordance with institutional policy.
