Waiver, Release and Assumption of Risk

In consideration of the student named above being permitted to participate in the activity or program described herein, the undersigned, on behalf of the student and the undersigned's heirs, assigns, personal representatives and next of kin, hereby releases, waives, discharges and covenants not to sue the school, its board members, officers, employees, volunteers, agents and representatives (collectively the Institution) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, injury or death that may be sustained by the student, or to any property belonging to the student, whether caused by the negligence of the Institution or otherwise, while participating in such activity or while in, on or upon the premises where the activity is being conducted.

The undersigned further expressly agrees that this release, waiver and assumption of risk is intended to be as broad and inclusive as permitted by the laws applicable to the Institution, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

The undersigned agrees to indemnify, defend and hold harmless the Institution from and against any and all claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees) arising out of or in connection with the student’s participation in the program, including claims brought by third parties.
