Eligibility, Obligations, and Conditions

Eligibility: Student represents that Student meets the eligibility criteria for lease aid under the Educational Institution's program and will immediately notify the Institution in writing of any change in eligibility status, including but not limited to enrollment status, withdrawal, suspension, or change of program.

Occupancy and Use: Aid is conditioned upon Student occupying the leased premises as primary residence for the term of the lease. Use of the premises for subletting or commercial purposes without prior written consent from the Institution voids the assistance for the period of unauthorized use.

Default and Repayment: If Student defaults under the lease, vacates before the lease end date, is subject to disciplinary removal from housing, or otherwise becomes ineligible under program rules, Student agrees to repay the Institution on a pro rata basis for any unearned aid. Repayment obligations are immediately due upon written demand. The Institution may offset future disbursements or other institutional funds against amounts due.

Compliance with Lease: Student must comply with all material terms of the lease. The Institution is not a party to the lease and has no obligation to enforce or modify landlord-tenant rights; Institution's assistance does not alter the parties' obligations under the lease between Student and Landlord.

Reporting, Documentation, and Records

Documentation: Student must provide a signed copy of the lease, landlord contact information, proof of rent due dates, and any other documents reasonably requested by the Institution to validate eligibility and process payments. All submitted documents shall be true and complete.

Representations, Warranties and Notices

Student represents and warrants that the information provided in this Exhibit and the supporting documentation is accurate and complete. Any material misrepresentation or omission shall be grounds for immediate termination of aid and demand for repayment.

Notices: All notices required under this Exhibit shall be in writing and delivered to the addresses provided in this form or to contact addresses otherwise provided in writing to the other party.

Privacy and Confidentiality

The Institution will maintain records of aid consistent with its records retention and privacy obligations. Student consents to disclosure of necessary information to the Landlord or property manager for the purpose of administering payments and verifying tenancy. The Institution will not disclose Student financial information except as required by law or with Student's written consent.

Acknowledgment and Certification

By signing below, Student (and Parent/Guardian, if applicable) certifies under penalty of perjury that the information provided is true and complete, agrees to the terms and conditions of this Exhibit, and authorizes the Institution to make payments as described herein and to pursue recovery of any amounts improperly paid.

Student consents to reasonable verification of eligibility and acknowledges that acceptance of aid does not create a tenancy relationship between the Institution and the Landlord nor does it alter the legal rights under the lease.

I have read and understand the terms of this Exhibit and agree to comply with the conditions set forth herein.

What the Educational Lease Aid Exhibit Is

The Educational Lease Aid Exhibit is a standardized supplemental document attached to a primary lease agreement that allocates, itemizes, and documents educational-related allowances, responsibilities, or modifications affecting leased property used for educational purposes. Typically prepared by landlords, school districts, or lessees, the exhibit clarifies financial contributions, compliance obligations, space usage provisions, and term-specific adjustments tied to educational programming. It functions as an enforceable exhibit incorporated into the lease, providing clear recordkeeping, assignment of costs, and a reference for audits, funding sources, and regulatory review during the lease term and any subsequent renewals.

Why a Dedicated Exhibit Matters

The Educational Lease Aid Exhibit creates a clear, written allocation of educational costs, responsibilities, and compliance conditions that reduces ambiguity between landlord and lessee, supports audit trails for funding sources, and helps ensure consistent enforcement of lease provisions tied to educational programs.

Why a Dedicated Exhibit Matters

Who Typically Prepares and Signs This Exhibit

Typical users include school districts, campus landlords, charter operators, and lessees managing educational programming within leased property.

  • School districts and charters use exhibits to allocate grants, facility fees, and program responsibilities for leased classrooms.
  • Campus landlords document landlord obligations for modifications, maintenance, and allowable use tied to educational tenants.
  • Nonprofit educational providers clarify funding sources, insurance, and special access terms for program delivery in leased space.

Using a standardized exhibit reduces negotiation time and provides a consistent record for audits, insurance, and grant compliance over the lease term.

Core Elements of a Professional Exhibit

A professional Educational Lease Aid Exhibit combines clear financial schedules, defined responsibilities, compliance references, signing blocks, supporting exhibits, and routing instructions for efficient administration.

Financial Schedule

Itemize costs, payment schedules, allocation percentages, and invoicing instructions. Provide line items that map to accounting codes and specify who bears each expense and when payments are due.

Roles & Duties

Define landlord, tenant, and third-party responsibilities for maintenance, accessibility, scheduling, and equipment. Reference applicable standards or code sections when required by funding or regulation.

Compliance Notes

List obligations tied to FERPA, HIPAA, grant terms, or local codes. Flag items requiring additional agreements, training, or privacy protections for educational operations.

Attachment List

Reference all supporting documents such as grants, insurance certificates, floor plans, and equipment lists. Indicate version, date, and who provided each attachment for auditability.

Signature Blocks

Provide separate signature lines for each party with printed name, title, date, and any notary or witness fields required by jurisdiction or funding source.

Routing & Retention

Note where originals are held, who receives copies, and retention period. Include instructions for filing, scanning, and redaction when sensitive student or health data is involved.
