Waiver, Release, Assumption of Risk and Indemnity

I, the undersigned employee, acknowledge that I am an adult and that my participation in assigned duties, trainings, team exercises, equipment operation, driving on behalf of the employer, off-site activities, and other employment-related tasks (collectively, the Activities) may involve inherent risks, including personal injury, illness, property damage, or death. I freely and voluntarily assume full responsibility for all risks, known and unknown, foreseeable and unforeseeable, that may arise from or relate to my participation in the Activities.

In consideration of the employer permitting me to engage in the Activities, I hereby release, waive, discharge, and covenant not to sue my employer, its parent, subsidiaries, affiliates, officers, directors, employees, agents, volunteers, successors and assigns (collectively, Released Parties) from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death, whether caused by the negligence of the Released Parties or otherwise, except for injuries resulting from the Released Parties' gross negligence or willful misconduct as defined by applicable law.

I agree to indemnify, defend and hold harmless the Released Parties from any loss, liability, damage or cost, including reasonable attorneys' fees and expenses, arising out of or related to my acts or omissions in connection with the Activities, including claims brought by third parties.

Medical Authorization; Emergency Treatment

I authorize the employer and its representatives to obtain or provide emergency medical treatment for me if I am injured or fall ill while participating in the Activities. I understand that I am responsible for all costs associated with such treatment and that the employer has no obligation to provide medical care. I certify that, to the best of my knowledge, I have no medical condition that would preclude my safe participation in the Activities, except as disclosed in writing below.

Photo/Video Release

I grant permission to the employer to record, photograph, or otherwise capture my image, voice, or likeness while participating in the Activities and to use such recordings or images for legitimate business purposes, training, promotional materials, or internal communications. I understand that such use is lawful and further release the Released Parties from any claims arising from such use.

Authorization to Conduct Background Checks and Drug/Alcohol Screening

I understand and authorize the employer to conduct pre-employment and ongoing background investigations, criminal record checks, motor vehicle record checks, and drug/alcohol screening where permitted by law. I consent to the release of relevant records and information to the employer and its authorized agents. I acknowledge that a positive result or adverse record may affect my eligibility for assignment to certain duties.

I consent to background checks and drug/alcohol screening as described above.

Specific Activities / Risk Acknowledgment

I acknowledge that my job duties may include activities that carry particular risks. I acknowledge the following activities that apply to my role and accept the associated risks:

Physical labor, lifting, climbing, or use of ladders.
Operation or driving of company vehicles or personal vehicles for business.
Operation of machinery, tools or powered equipment.
Off-site or client-location work and travel.
Other risks (describe):

At-Will Employment & Equal Opportunity

Nothing in this Waiver modifies the at-will nature of the employment relationship, unless otherwise agreed in a separate signed written agreement. Either the employee or the employer may terminate the employment relationship at any time, with or without cause or notice, to the extent permitted by law.

The employer is an equal opportunity employer. Employment decisions are made without regard to race, color, religion, sex, national origin, age, disability, genetic information, or any other protected characteristic under applicable law.

Applicant Certification and Acknowledgment

I certify that all information provided in this document is true, complete, and correct to the best of my knowledge. I acknowledge that I have carefully read this Waiver and fully understand its contents. I am aware that by signing below I am giving up substantial legal rights, including the right to sue the Released Parties, and I sign this Waiver freely and voluntarily.

I further acknowledge that if any provision of this Waiver is held invalid or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

What the Employee Adult Waiver Is and When to Use It

An Employee Adult Waiver is a signed document in which an employee who is legally an adult acknowledges specific risks, releases certain claims, or agrees to assume responsibility for activities or conditions set by an employer. Typical uses include voluntary training exercises, physical activities, off-site events, or situational releases tied to workplace programs. The form clarifies parties, scope, effective dates, and consideration, and is drafted to reflect applicable state law, capacity requirements, and public-policy limits so that the waiver can serve as an enforceable record of the employee’s informed consent.

Why an Employee Adult Waiver Matters for Employers and Employees

An Employee Adult Waiver documents informed consent and risk allocation between employer and adult employee, reducing ambiguity about duties and exposures.

Typical Roles That Prepare or Sign an Employee Adult Waiver

The document is used by HR, safety teams, managers, and legal counsel when employees participate in optional or higher-risk activities.

  • HR and Benefits Teams — prepare HR-compliant language, ensure record retention, and handle employee inquiries about terms and consent.
  • Safety and Operations Managers — document hazard acknowledgements, verify training completion, and ensure appropriate supervision is specified in the waiver.
  • In-House Counsel or Outside Counsel — review enforceability, tailor waiver scope to state law, and advise on public policy exceptions.

Different stakeholders focus on drafting, verification of capacity, collecting signatures, and retaining the executed document in personnel records.

Representative Signers and Their Responsibilities

HR Manager — Benefits Administrator

Typically responsible for inserting standard waiver language, confirming the document is in employee personnel files, verifying the employee is of legal age, and coordinating any required follow-up such as accommodations or alternative dispute-resolution clauses.

Safety Officer — Site Supervisor

Usually ensures the waiver accurately reflects on-site risks, documents any safety briefings provided to the employee, confirms witness or notarization requirements when required by policy, and retains evidence of training or instruction tied to the waiver.

Essential Elements of a Professional Employee Adult Waiver

A well-constructed waiver is concise, legally informed, and tailored to the activity and jurisdiction; include these core elements to improve clarity and enforceability.

Parties

Clearly identify the employer and the adult employee by legal name and contact details so the agreement binds the correct persons.

Scope

Define the specific activities, locations, date range, and the hazards the employee is acknowledging or assuming.

Assumption of Risk

Use explicit language that the signer knowingly accepts listed risks, avoiding vague or overly broad disclaimers.

Release and Indemnity

State the release scope and any indemnification obligations, mindful of public-policy limitations on waiving liability.

Consideration

Document what the employee receives in exchange for the waiver, including pay, access, or other tangible benefits.

Execution Details

Include signature, printed name, date (MM/DD/YYYY), witness or notary blocks if required, and a copy-provision for the signer.

Practical Tips to Improve Waiver Accuracy and Enforceability

Follow these best practices to reduce legal risk and make waivers easier to administer and defend.

Obtain tailored legal review
Have counsel review waiver language for your jurisdiction, industry, and activity to avoid unenforceable clauses and public-policy conflicts.
Use plain language summaries
Provide a short plain-language explanation of key rights and risks near the signature so the signer understands the document.
Verify capacity and voluntariness
Confirm the employee is sober, competent, and signing voluntarily; document any witness verification or supervisory presence.
Maintain clear retention and access
Store signed waivers in HR systems with controlled access and an indexed retention schedule tied to your organization’s record policies.

Common Mistakes to Avoid When Preparing a Waiver

  • Using overly broad release language that conflicts with state public-policy limits can render the waiver unenforceable or invite litigation.
  • Failing to verify that the signer is an adult and has capacity at signing increases the risk that a court will void the release.
  • Not tailoring the waiver to the specific activity or omitting detailed hazard descriptions weakens the document’s evidentiary value.
  • Poor recordkeeping, such as storing unsigned or outdated templates, creates uncertainty about which terms applied at the time of an incident.

Potential Legal Risks and Consequences of Defective Waivers

Unenforceability: Waiver may be voided by courts
Negligence claims: Release may not bar gross negligence suits
Minor signers: Waivers signed by minors are voidable
Regulatory fines: Noncompliance in regulated contexts
Evidence gaps: Missing witness or signature metadata
Privacy breaches: Improperly handled health data risks HIPAA penalties

Real-World Use Cases for Employee Adult Waivers

These scenarios illustrate how waivers are applied across common workplace situations and the documentation practices that support them.

Company Fitness Program

A mid-size employer offers optional fitness classes to employees and requires a waiver describing physical risks

  • the waiver clarifies voluntary participation
  • the employer retains signed PDFs in HR and documents the instructor’s safety briefing for incident defense.

Off-Site Team Event

An operations team attends a ropes-course retreat and signs a tailored waiver listing inherent risks

  • the waiver includes emergency contact details and consideration of paid time
  • the company uses secure eSignature with an audit trail and stores copies with the safety officer.

Timing and Deadlines When Collecting and Retaining Waivers

Timely execution and retention reduce evidentiary disputes; align collection with the scheduled activity and follow retention rules after execution.

Execution timing:

Collect the signed waiver before the employee participates in the activity

Immediate retention:

Store executed copy in HR within 24–72 hours

Incident preservation:

Preserve related records immediately after any incident

Review cadence:
