Testing Methodology: Tests will be conducted by qualified personnel using approved breath, saliva, or other reliable testing methods. Confirmatory testing will be used when required by internal procedures. Test results will be handled in accordance with confidentiality provisions below.

Consequences and Discipline

A confirmed violation of this policy may result in disciplinary action up to and including termination. Disciplinary measures will be applied consistently and may include removal from duty, suspension, mandatory participation in an approved treatment program, or termination. The Company will consider job safety, prior conduct, applicable contracts, and legal obligations when determining discipline.

Medical, Rehabilitation and Leave

Employees who self-report a dependency or seek assistance prior to a violation may be eligible for leave and referral to an Employee Assistance Program or approved treatment provider. Requests for accommodation or medical leave will be considered in accordance with applicable law and Company leave policies.

Confidentiality and Records

Test results, medical information, and treatment records are confidential and will be disclosed only to persons with a legitimate need to know, or as required by law. The Company will retain records in compliance with applicable recordkeeping requirements.

What an Employee Alcohol Policy Covers

An Employee Alcohol Policy sets clear workplace standards for alcohol use, possession, and impairment. It defines where and when alcohol is prohibited, identifies safety-sensitive roles, explains testing procedures and disciplinary steps, and describes support options such as employee assistance programs. The policy scopes covered personnel (employees, contractors, temporary staff), specifies reporting and investigation procedures for suspected violations, and outlines recordkeeping and confidentiality practices to meet labor and privacy obligations.

Why a Formal Policy Matters

A written policy reduces ambiguity, supports consistent enforcement, and helps manage legal and safety risk. It also documents employer expectations and available support while aligning workplace conduct with regulatory obligations and industry standards.

Why a Formal Policy Matters

Who Should Read or Adopt This Policy

Use this policy as a baseline; adapt language for company size, state law, collective bargaining agreements, and high-risk roles.

  • Human resources teams responsible for drafting and maintaining workplace policies and procedures.
  • Frontline supervisors who investigate incidents and apply disciplinary measures according to policy.
  • Legal, compliance, and occupational safety staff ensuring alignment with federal and state requirements.

Core Elements to Include in an Effective Policy

A comprehensive Employee Alcohol Policy balances clear prohibitions with testing procedures, accommodation guidance, confidentiality protections, and defined consequences. Each element should be actionable and legally reviewable.

Scope

Define which workers and locations are covered, including off-duty conduct that affects safety-sensitive positions or company reputation, and include contractors and temporary staff where applicable.

Prohibited Conduct

List forbidden behaviors such as reporting to work impaired, consuming alcohol on company property, or possessing alcohol in restricted areas, and explain how impairment will be assessed.

Testing Procedures

Describe types of testing (pre-employment, post-incident, reasonable suspicion), sample methods, consent requirements, and chain-of-custody steps to preserve integrity and fairness.

Disciplinary Framework

Set progressive consequences ranging from counseling and referral to termination for repeated or severe violations, and specify investigatory steps and appeal rights.

Accommodation & Assistance

Explain how employees may request medical or disability accommodations and outline referral to employee assistance programs (EAPs) or treatment options while protecting confidentiality.

Recordkeeping

State how records are stored, who has access, retention periods, and compliance with applicable privacy laws and internal retention schedules.
