What an Employee Bonus Profit Share Agreement Is

An Employee Bonus Profit Share Agreement is a written contract that defines how discretionary or formula-based bonuses and profit-sharing payments are calculated, approved, and distributed to employees. It identifies parties, eligibility criteria, performance metrics, payment schedule, tax withholding responsibilities, and conditions for modification or termination. Employers use this agreement to document compensation practices, align incentives, and reduce disputes. When executed electronically, the agreement is enforceable under federal ESIGN and state UETA statutes provided intent, consent, signer attribution, and retention requirements are met.
