What the Employee CNA Agreement Is

An Employee CNA Agreement is a written employment contract between a healthcare employer and a Certified Nursing Assistant (CNA) that sets out job duties, work schedule, pay, licensure verification, confidentiality obligations and basic disciplinary or termination procedures. The document clarifies supervision, training requirements, overtime and on-call expectations and usually includes patient privacy and HIPAA-related clauses. It may also address background checks, immunization requirements and any credential renewal responsibilities. A complete agreement reduces misunderstandings and provides a record of terms for payroll, licensing and compliance audits.

Why a Clear Agreement Matters

A concise Employee CNA Agreement protects patients and employers by documenting duties, pay and HIPAA responsibilities, reducing disputes and supporting regulatory compliance while making onboarding and staffing decisions more efficient.

Why a Clear Agreement Matters

Who Typically Prepares and Signs This Agreement

The Employee CNA Agreement is used by organizations that employ CNAs and by CNAs themselves during hiring or transfer.

  • Nursing homes — HR or staffing managers issue standardized agreements at hire or rehire to document shifts and training.
  • Home health agencies — clinical administrators use agreements to confirm scope of home visits, mileage reimbursement and client safety rules.
  • Hospitals and clinics — nurse managers and HR finalize terms for float pools, on-call obligations and unit assignments.

Use this agreement to create consistent employment records, support licensing checks, and document consent to privacy and workplace policies.

Core Sections to Include in an Employee CNA Agreement

A professional Employee CNA Agreement groups essential topics so duties, compensation, compliance and termination are clear for both parties.

Employment Term

Specify whether employment is at-will or for a fixed term, include start date and any probationary period, and note how renewals or extensions are handled.

Duties and Scope

List primary clinical and nonclinical tasks, supervision structure, expected certifications, mandatory training and limits on duties outside CNA scope of practice.

Compensation

Describe hourly rate or salary, overtime rules, pay frequency, shift differentials, on-call pay and any benefits or reimbursement policies.

Schedule and Attendance

State standard work hours, shift rotations, call requirements, required notice for time-off requests and procedures for shift swaps or coverage.

Confidentiality and HIPAA

Include patient privacy obligations, authorized access limits, breach reporting steps and any required HIPAA training or attestation language.

Termination and Discipline

Describe cause for immediate termination, progressive discipline steps, notice requirements and post-termination obligations such as return of property.

How to Complete the Agreement, Step by Step

Follow these sequential steps to prepare, review and finalize an Employee CNA Agreement efficiently.

  • 01
Collect documents: Gather license, ID, background check and immunization records.
  • 02
Populate fields: Enter names, dates, pay rates and work location accurately.
  • 03
Review compliance: Confirm HIPAA language, training requirements and I-9 documentation.
  • 04
Execute signatures: Obtain signatures from CNA and authorized employer representative.

Technical Considerations for eSigning and Storage

Choose a platform that supports required file formats, secure authentication and compliant retention.

  • File formats: PDF and DOCX supported
  • Integrations: Connect to HRIS and payroll
  • Authentication: Email, SMS, or ID proofing

Ensure the selected system provides an audit trail, encrypted storage and methods for exporting signed records for payroll and licensing audits.

Typical Digital Signing Flow

A clear four-step eSignature flow reduces friction and preserves an evidentiary audit trail for each agreement.

  • Upload document: Add the finalized template to the platform
  • Add fields: Place signature, date and checkbox fields
  • Send to signer: Deliver via email link or secure portal
  • Complete and archive: Signed copy and audit record saved

Key Deadlines and Compliance Timelines

Track federal and administrative deadlines that commonly apply when onboarding CNAs and maintaining employment records.

W-2 Distribution:

Provide W-2 to employee by Jan 31 each year

I-9 Retention:

Retain I-9 for 3 years after hire or 1 year after termination (8 CFR §274a.2)

W-9 Provision:

HIPAA Records:

Retain HIPAA-related records for 6 years (45 CFR §164.530(j))

Background Check Updates:

Recheck or document updates per state or employer schedule

Common Preparation Errors to Avoid

  • Incomplete license details — missing expiration or issuing state can prevent lawful assignment of clinical duties and delay onboarding.
  • Omitted HIPAA acknowledgement — failing to document privacy training increases risk of noncompliance and regulatory scrutiny.
  • Vague pay terms — not specifying overtime rates or shift differentials causes payroll disputes and potential wage claims.
  • Incorrect effective dates — backdating or inconsistent dates can affect benefits eligibility and liability windows.

Consequences of Errors or Noncompliance

HIPAA Violation: Civil and criminal penalties with substantial fines
I-9 Violations: Fines ranging widely per violation (DHS enforced)
Wage & Hour Claims: Back pay, penalties and interest may apply
Tax Reporting Errors: Late or incorrect forms can trigger IRS penalties
Negligent Hiring: Liability exposure if employee causes harm
License Sanctions: State boards may suspend or revoke credentials
