Purpose and Scope

Purpose: The Company establishes this Employee Conceal and Carry Policy to define the conditions, requirements and procedures under which employees may possess a lawfully concealed firearm while on Company premises or in Company-controlled vehicles. This Policy is intended to comply with applicable law, protect the safety of employees and third parties, and set forth disciplinary consequences for noncompliance.

Scope: This Policy applies to all employees, contractors and temporary workers of the Company at all facilities and during all Company-sponsored activities except where state or federal law precludes application.

Definitions

Concealed Firearm: any loaded or unloaded firearm capable of being carried on a person or in a vehicle in a manner not readily visible to the ordinary observation of another person.

Policy Statement

General Rule: Employees are prohibited from carrying or storing firearms on Company premises or in Company-controlled vehicles except where an employee has obtained written authorization under this Policy and otherwise complies with all conditions set forth herein and applicable law. Authorization is a revocable privilege, not a right.

Prohibited Conduct: Possession of a firearm in restricted areas, failure to notify Human Resources of required changes to legal status affecting eligibility, bringing a firearm while under the influence of alcohol or illegal drugs, and any unsafe storage or handling are strictly prohibited and may result in disciplinary action up to and including termination and criminal prosecution.

Eligibility and Required Documentation

Eligibility: To be eligible for authorization an employee must: be at least eighteen years of age or meet any higher age required by law; possess an active and lawful concealed carry authorization recognized in the jurisdiction where the employee proposes to possess a firearm; have no disqualifying criminal convictions; and have completed any training or certification required by the Company.

Documentation Required: Employees seeking authorization must submit to Human Resources: a completed Authorization Request form; a legible copy of their concealed carry license or permit; proof of completion of any Company-required safety training; written consent to a background check; and any other documents reasonably requested by the Company to verify eligibility.

The Company may add or remove restricted areas at its discretion.

Vehicles and Storage: When stored in a personal vehicle on Company premises, firearms must be unloaded and locked in a secure container not accessible from the passenger compartment, unless prohibited by applicable law. Firearms may not be stored in Company-owned vehicles unless specifically authorized in writing.

Response to an Incident Involving a Firearm

Use of Force: Use of a firearm is permissible only to the extent allowed by law and only in cases of imminent threat of death or serious bodily injury. Employees must immediately notify law enforcement and Company Security (if applicable) and must notify Human Resources as soon as feasible following any incident involving discharge or use of a firearm.

Preservation of Evidence: An employee who discharges a firearm on Company premises must preserve the scene and cooperate with law enforcement and Company investigations. Failure to cooperate may result in disciplinary action.

Discipline; Revocation of Authorization

Discipline: Violation of this Policy or furnishing false or misleading information in connection with an authorization request will result in disciplinary action up to and including termination of employment. The Company reserves the right to take immediate action, including suspension or revocation of authorization, when an employee's conduct creates an immediate safety concern.

Revocation: The Company may revoke authorization at any time for cause or when continued authorization would create an undue risk to safety or a breach of law or Company policy.

Legal Compliance; Liability and Indemnification

Compliance with Law: Employees must comply with all applicable federal, state and local laws governing firearm possession. This Policy does not supersede or alter legal obligations under applicable statute or regulation.

Liability: The Company expressly disclaims any obligation to protect employees through authorization of concealed carry. Employees assume all personal liability for their lawful or unlawful acts associated with possession or use of a firearm. To the fullest extent permitted by law, the employee agrees to indemnify and hold the Company harmless from claims arising from the employee's possession or use of a firearm on Company premises except where caused by the gross negligence or willful misconduct of the Company.

Confidentiality

Employee records, including authorization requests and background check information, will be maintained in a confidential file in Human Resources and disclosed only to Company personnel with a need to know, to law enforcement as required, or as otherwise required by law.

What the Employee Conceal and Carry Policy Is

An Employee Conceal and Carry Policy is an internal workplace rule set that defines whether, when, and how employees may possess or conceal firearms while on company property, at company events, or in company vehicles. It establishes eligibility criteria, permitted locations, storage and security requirements, reporting obligations, training expectations, and disciplinary consequences. The policy balances workplace safety, operational needs, and legal compliance and is typically incorporated into the employee handbook or appended as a signed acknowledgement for covered staff.

Why a Clear Policy Matters for Employers

A written policy reduces ambiguity, documents employer expectations, supports consistent enforcement, and provides a record of employee acknowledgement. It helps manage liability and safety risks while demonstrating reasonable steps to address workplace security.

Why a Clear Policy Matters for Employers

Who Typically Creates and Acknowledges This Policy

Employers in safety-sensitive, public-facing, or regulated workplaces generally adopt conceal-and-carry rules as part of HR and risk management programs.

  • Human resources teams and risk managers who draft, update, and enforce workplace conduct policies.
  • Site and facility managers who implement location-specific access controls and signage.
  • Employees required to complete permit verification, training, and written acknowledgements before authorization.

Employees subject to the policy sign attestations; managers and HR staff administer training, review requests, and enforce rules.

Who Signs and Approves the Policy

HR Lead

Human Resources or the designated HR lead typically drafts the policy, coordinates legal review, manages employee communications, and retains signed acknowledgements. HR enforces compliance, documents training completion, and tracks revocations or restrictions.

Senior Manager

An authorized company officer or senior manager provides final approval and signature on behalf of the employer, confirms site-specific exceptions, and ensures the policy aligns with operational safety plans and insurance requirements.

Core Elements Included in a Professional Policy

A robust Employee Conceal and Carry Policy contains definitions, eligibility criteria, permitted locations, training obligations, reporting procedures, and enforcement measures tailored to the employer's operational footprint.

Definitions

Clear definitions for terms such as 'employee', 'permit holder', 'company property', and 'authorized location' to avoid ambiguity and guide enforcement.

Eligibility

Criteria for authorization, including permit verification, background check requirements, position restrictions, or exclusion of safety-sensitive roles.

Permitted Locations

Explicit list of where concealed firearms are allowed, restricted, or prohibited (offices, common areas, vehicles, events), including signage rules.

Training

Required training topics, frequency, documentation of completion, and standards for safe storage and handling while on duty or on-site.

Reporting

Incident reporting obligations, immediate notification procedures for security or HR, and confidentiality protections for involved parties.

Enforcement

Consequences for violations, revocation processes, appeal rights, and disciplinary or termination standards aligned with company policy.

Common Mistakes to Avoid

  • Failing to align the policy with state law creates legal exposure and inconsistent enforcement, especially where statutes limit employer restrictions.
  • Vague location definitions lead to disputes and uneven application; precisely list buildings, rooms, parking areas, and offsite events.
  • Not documenting training completion or permit verification undermines defensibility in incidents and may jeopardize insurance coverage.
  • Using insufficient signer authentication for electronic acknowledgements risks challenges to enforceability under ESIGN or state law.

Penalties, Liability, and Operational Risks

Regulatory Penalty: Fines or sanctions
Civil Liability: Negligence claims possible
Insurance Impact: Coverage disputes or premium increases
Workplace Safety: Increased accident risk
Reputational Harm: Public scrutiny and trust erosion
Operational Disruption: Evacuations or investigations

Practical Tips for Accurate and Efficient Implementation

Apply consistent processes and clear documentation to minimize disputes and administrative overhead.

Standardize the Form
Use a single, version-controlled policy document and form to ensure every employee signs the same terms and to simplify audits.
Require Permit Proof
Collect a copy of the permit and record expiry dates to automate reminders and re-verification before authorization lapses.
Use Strong Authentication
Require multi-factor or ID verification for electronic signings to strengthen attribution and reduce repudiation risks.
Maintain Training Records
Document completion dates, curricula, and instructor credentials so training obligations are demonstrable after incidents.
